Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the case is under examination of DC (MSME) and comments are awaited. Hence, it was decided to defer the case for re-listing on 13.11.2008.

M/s Kitex Garments Ltd,. Kochi F.NO.1/84/50/248/AM07-DES-V No.1010024252 dt. 25.08.2006 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. Siva Sankar, Asstt. Manager (Imports), who appeared for personal hearing. He could not submit the relevant details/information in justification pertaining to the case, in absence of which Committee was not in a position to compute the requirement of inputs asked by the firm. It was therefore, decided to advise the firm to furnish CAD/CAM/Laymarker/Style/Measurement/calculation sheet and sample for finalization of the input output norms. Hence, it was decided to re-open the case on receipt of the above details from firm.

M/s Maccaferri Environmental Solution Pvt. Ltd. F.NO.1/84/50/138/AM09-DES-V No.3110033408 dt. 04.04.2008 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. Mayur Jain, C.A and Sh. Pahim, authorized representatives of the firm, who appeared for personal hearing. They explained the case alongwith sample and process flow chart of Paraweb. The Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to ratify the advance authorization issued in this case as detailed below:- (i) The item of import at S.No.1 may be allowed with 3% wastage. Firm have to account for 59208 Kgs of relevant polyester filament yarn in the export product. (ii) The items of import at S.No.2 and 3 may be allowed with 5% wastage; (iii) The description of export item may be amended to read as “ Paraweb containing relevant polyester filament yarn – 59208 Kgs, White Polymer LLDPE – 89091 Kgs and PE master batch (black) –3542 Kgs”. (iv) The description of import item may also be amended accordingly.

PRO version technical authorities present in the meeting observed that earlier decision of NC as per recommendations of TC, Mumbai was based on specific design and CAD. Hence, it was decided that case cannot be reconsidered as per SION, J-272 as referred by firm. Therefore, rejected the request of the firm.

Vinay Khetan, an authorized representative of the firm, who appeared for personal hearing. He explained the case stating that in this case undyed fabrics is dyed first and then stitched to garments. In this case process of dyeing of fabric is involved. The Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to clarify that prepared for dyeing (PFD) fabric is also covered under SION, J-175, as such in this case also relevant fabric may be allowed @ 2.45 Sq mtrs./Pc with 10% GSM variation (in terms of General Note for Textiles at S.No. 15).

He explained the case stating that in this case undyed fabrics is dyed first and then stitched to garments. In this case process of dyeing of fabric is involved. The Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to clarify that prepared for dyeing (PFD) fabric is also covered under SION, J-175, as such in this case also relevant fabric may be allowed @ 2.45 Sq mtrs./Pc with 10% GSM variation (in terms of General Note for Textiles at S.No. 15).

CAD, CAM, Measurement, calculation sheet and sample in justification pertaining to this case, Committee was not in a position to compute the requirement of import item no. 2, which was earlier not allowed. However, as regards import item no. 3 i.e Poppers, Committee decided to enhance it to 10 Nos per piece in partial modification of earlier decision. Firm may be informed accordingly
