The Meeting No. 52/AM-11 for the licensing year 2010-11 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 24.03.2011 in Room No.213 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC Meeting No.51/AM11 dated 17.03.2011 were ratified. Thereafter agenda for Meeting No.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that from the description export item given it is seen that there are two export item (i) Lunch Bag and (ii) Back Pack, but firm have neither given drawing, design, size-wise specification of each item separately. Further, as per Appendix-11A, the quantitative requirement of input has been sought 0.20 Sq mtr./Pc and 0.70 Sq mtrs. /Pc with 10% wastage. The Committee felt that in absence of above details/information, it is not possible to compute the requirement input, hence, constrained to reject the case.

                 RLA may take suitable consequential action accordingly.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that from the description of imported item; it is not clear whether the item is in gummed or degummed stage. They have also not given technical characteristics of each grade of input viz. Mulberry silk struna, mulberry silk Xolst-1 passage and mulberry silk Xolst-2 passage justifying their difference. The process of manufacturing silk sliver and silk noil yarn is different. Process flow chart submitted also does serve the purpose. Further, three export items have been mentioned for three different type of inputs given and nothing is available to justify that the export item manufactured in

PRO version y g g j y the single export description in this case. In view of the above, it is not possible to compute the requirement input, hence, constrained to reject the case.

                 RLA may take suitable consequential action accordingly.

Accordingly, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance authorization issued in this case as detailed below: - (i) The item of import at S.No. 1 and 3 against export item 1 and 2 may be allowed @ 1.60 Sq mtrs./Pc (ii) The item of import at S.No. 2 and 4 against export item 1 and 2 may be allowed on net to net basis with accountability clause.

The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

Further, they have also not given drawing, design, measurement & justification for the lining material asked for. In view of the above, it is not possible to compute the requirement input, hence, constrained to reject the case.

M/s Superhouse Ltd., Kanpur NC No.52/AM11 Pt.F.No.01/84/50/94/AM08/DES-V Dated 24.03.2011 Re-fixation of input output norms in respect of Advance Authorization No.0610012100 dated 03.07.2007. Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting felt that it is not possible to vary the Qty. of individual item as per SION, G-9, if though catalyst is not imported, any other item cannot be allowed or with increased Qty. Therefore, Committee decided to reject the request of the firm.

Decision: The Committee considered the case as per agenda and observed that this case has already been cleared by NC in its meeting held on 26.11.2009. The Committee went through the request of the firm and after due deliberations in consultation with the representatives of technical authorities present in the meeting decided to rectify the earlier decision as detailed below: - S. M/s Jayanita, Greater Noida

PRO version NC No.52/AM11 F.No.01/84/162/576/AM11/DES-V Dated 24.03.2011 Clarification on admissibility of DEPB rate under composite item as per condition No.11 of DEPB rate schedule. Decision: The Committee considered the case as per agenda and observed that PC-4(B) Section have sough clarification with regard to admissibility of DEPB rate under composite item as per condition No. 11 of DEPB rate schedule. The Committee felt that cushion is composed of cushion cover and filling material which may be polyester staple fibre or foam or any other material. In this case export product is composite item i.e Cushions made of polyester fabric & or blended fabric (polyester & cotton) &/or cotton fabric and polyester staple fibre as filler. In the DEPB schedule entry at S.No. 556 for Chemical Product Group, the DEPB rate for polyester staple fibre has already been specified. Therefore, Committee after due deliberations in consultation with technical authorities present in the meeting felt that in this case export product is cushion cover which is a composite item could be classified under General Note No.11 of DEPB schedule. It was therefore, decided to refer back the case file of PC-4(B) Section for their information and necessary action.

Case No. 479

M/s Arvind Ltd., Ahmedabad NC No.52/AM11 F.No.01/84/50/234/AM11/DES-V Dated 24.03.2011 Re-fixation of input output norms in respect of Advance Authorization No.0810093729 dated 04.11.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that firm have informed the Committee that there has been some error on their part. They have also informed that they will import cotton dyed denim fabric after over dyeing only, hence, description of export item may be considered as

PRO version ‘cotton dyed denim fabric- over dyed by deleting the words ‘and/or coated’ in this case. The Committee felt that in any case if Committee allowed this deletion, there is no justification for seeking higher wastage of 7% in this case, as it is simply dying process carrying in CDR. Therefore, no more than 2% wastage can be allowed in this case. Accordingly, it was decided to ratify the advance authorization issued in this case by allowing 2% wastage as detailed below:- S. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted by the firm. The Committee observed that the style No. of both the export item is 330669. Therefore, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to re-fix the norms against the subject Advance authorization as detailed below: - S. M/s Lumens India, Kolkata NC No.52/AM11 Pt.F.No.01/84/50/183/AM11/DES-V Dated 24.03.2011 Re-fixation of input output norms in respect of Advance Authorization No.0210148852 dated 05.10.2010. Decision: The Committee considered the case as per agenda and observed that this case has already been cleared by NC in its meeting held on 18.11.2010 but there was some typographical error. The Committee after due deliberations in consultation with the representatives of technical authorities present in the meeting decided to rectify the earlier decision as detailed below: - S. Decision: The Committee considered the case as per agenda and observed that the case is under examination of DC (MSME) and comments. It was therefore decided to defer the case for re-listing on 21.04.2011.
