Minutes of NC-V Meeting held on 19.08.2010
The Meeting No. 21/AM-11 for the licensing year 2010-11 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 19.08.2010 in Room No.213 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC Meetings held earlier were ratified. The Agenda for individual cases for Meeting No. 21/AM11 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

In absence of the above details, it is not possible to compute the requirement of inputs in this case. Hence, Committee was constrained to reject the case. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in the export item description, 67% Cashmere & 33% Bamboo blended sweaters whereas in the import item description 100% pure cashmere yarn. Further, export Qty. given is 222.352 Kgs (67% of which is 149 Kgs of cashmere) and import Qty. asked for is 111.170 Kgs, which is impossible to manufacture. Hence, Committee was constrained to reject the case. RLA may take suitable consequential action accordingly.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to give another P.H to the applicant firm before NC meeting to be held on 16.09.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. P.S.Sethi, an authorized representative of the firm, who appeared for personal hearing along with one technical person before Committee. They explained the case alongwith sample, which were in different various sizes. They showed the sample of donut bed cushion. The relevant details were not available with them, hence, representative of the firm was advised to submit the same and it was decided to defer the case for re-listing on 16.09.2010.

M/s Jiwan ram Sheoduttrai Industries Pvt. Ltd., Kolkata NC No.21/AM11 F.No.01/84/50/14/AM10/DES-V Dated 19.08.2010 Authorization No.0210125566 dated 16.04.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. Sunil Jain, an authorized representative of the firm, who appeared for personal hearing before Committee. He explained the case along with sample and relevant details. The sample was checked and observed that sizes are larger than the normal range of coverall. The Committee felt that higher requirement of inputs asked for is justified in this case. Therefore, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance authorization issued in this case as applied by the firm. The sample received in this case was handed over to the representative of the firm. The GSM should match in both import and export. The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

M/s Jiwan ram Sheoduttrai Industries Pvt. Ltd., Kolkata NC No.21/AM11 F.No.01/84/50/392/AM10/DES-V Dated 19.08.2010 Authorization No.0210129865 dated 31.07.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that as another case of the same firm was discussed in the personal hearing of this meeting, this case was also taken up. It was observed that earlier NC had allowed only the item of import No. 4 to 10 on net to net basis with 1% wastage and import item No. 1 to 3 were disallowed. The sample received in this case was also seen. The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to allow the item of import No. 1 to 3 as applied by the firm in partial modification of its earlier decision. The sample received in this case was handed over to the representative of the firm.
The GSM should match in both import and export. The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

M/s Jiwan ram Sheoduttrai Industries Pvt. Ltd., Kolkata NC No.21/AM11 F.No.01/84/50/130/AM10/DES-V Dated 19.08.2010 Authorization No.0210131920 dated 23.09.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that as another case of the same firm was discussed in the personal hearing of this meeting, this case was also taken up. It was observed that earlier out of total 13 import item, NC had allowed all the item of import as applied by the firm except item of import at S.No. 9 against export item No. 9. The Committee felt that there was some typographical error in the minutes. Therefore, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to allow the item of import No. 9 against export item No. 9 as applied by the firm in partial modification of its earlier decision.

It was observed that earlier this case was rejected. The sample was checked and observed that sizes are larger than the normal range of coverall. The Committee felt that higher requirement of inputs asked for is justified in this case. Therefore, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance authorization issued in this case as applied by the firm. M/s Chandramukhi Impex Pvt. Ltd., Kolkata NC No.21/AM11 F.No.01/84/50/209/AM10/DES-V Dated 19.08.2010 Authorization No.0210135620 dated 18.12.2009. Decision: The Committee considered the case as per agenda and written comments received from DC (MSME) conveyed vide their U.O No. 37(5)/25/2010-11/Hosy. dated 12.08.2010 by allowing the item of import @ 4.24 Sq mtrs./Pc taken on record. It was observed that firm have asked the input @ 4.24 Sq mtrs./Pc and relevant SION permits @ 4.05 Sq mtrs./Pc. Therefore, Committee decided to allow the item of import @ 4.05 Sq mtrs./Pc in terms of Policy Circular No. 34 dated 24.03.2008.
The GSM should match in both import and export. The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.
Case No.208
M/s Imperial Readymade Garments Factory India Pvt. Ltd., Chennai NC No.21/AM11 F.No.01/84/50/146/AM10/DES-V Dated 19.08.2010 Authorization No.0410108432 dated 13.10.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and perused the written comments of DC (MSME) conveyed vide their U.O No. 37(5)/24/2010-11/Hosy. dated 19.08.2010. It was observed that there are three different type of garments made from six different type of fabrics and firm have submitted only sketches of export items and have not submitted measurement, CAD & calculation sheet. The use of six different type of fabrics in three export items has also not been given alongwith justification thereon. In absence of this it is not possible to compute the requirement of inputs. Hence, Committee was constrained to maintain status quo in this case.

M/s Veenar Fashions, Mumbai NC No.21/AM11 F.No.01/84/50/56/AM07/DES-V Dated 19.08.2010 Authorization No.0310380200 dated 12.05.2006. Decision: The Committee considered the case as per agenda and observed that earlier this case was decided by NC on 12.06.2008 as per written comments of TC, Mumbai and subsequently reviewed on 07.01.2010. But now firm have informed that description & style No. mentioned in the said minutes of NC are not matching with the description & style No. given in application. Therefore, the relevant details were checked from application and found that there was indeed some typographical error in the minutes. Decision: The Committee considered the case as per agenda alongwith other relevant papers and after deliberations in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance authorization issued in this case by allowing the item of import No. 1 with 20% wastage. The item of import No. 2 i.e Furnace Oil may be allowed as per relevant existing General Note for fuel. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.
