At the outset the Minutes of NC Meeting No. 48/AM11 dated 24.02.2011 and Meeting No. 49/AM11 dated 03.03.2011 were ratified. Thereafter agenda for individual cases for Meeting No. 50/AM11 dated 10.03.2011 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was cleared by erstwhile ALC in its meeting held on 23.06.2005 by allowing the item of import as applied by the firm for export of Ladies Blouse with winged collar. The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting felt that for exports made prior to the communication of ALC decision may be taken into account for regularization purpose in this case. R.A may regularize the case accordingly based on the factual position. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

Case No. 455

M/s Shabanesa, Chennai NC No.50/AM11 F.No.01/85/50/78/AM11/DES-V Dated 10.03.2011 Ratification of input output norms in respect of Advance Authorization No.0410115363 dated 08.07.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and perused the comments of DC (MSME), Chemical Division conveyed vide their U.O dated 23.02.2011. The Committee felt that for any import into the country that may happen any contagious disease element, Government of India already put Sanitary & Phytosanitary measures. Therefore, the need for seeking views of M/o Health & Family Welfare as suggested by DC (MSME) in this case is unwarranted at this stage. Thus, Committee decided to maintain status quo in this case.

The Committee felt that for any import into the country that may happen any contagious disease element, Government of India already put Sanitary & Phytosanitary measures. Therefore, the need for seeking views of M/o Health & Family Welfare as suggested by DC (MSME) in this case is unwarranted at this stage. Thus, Committee decided to maintain status quo in this case.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was cleared by NC in its meeting held on 13.01.2011. Now firm have informed that due to revision in usage as per buyers order, the Qty. of import item No.3 i.e FR refractive tape (yellow with silver stripe) 50MM has been enhanced from 782.90 Sq mtrs. to 876.10 Sq mtrs. The Committee after due deliberations in consultation with representatives of technical authorities present in the meeting decided to allow enhancement in respect of import item No.3 i.e FR refractive tape (yellow with silver stripe) 50MM from 782.90 Sq mtrs. to 876.10 Sq mtrs against the advance authorization in question. Decision: The Committee considered the case as per agenda and observed that this case was cleared by NC in its meeting held on 08.11.2007 with three export items. Firm had requested for one additional i.e 4th export item i.e Ladies other outer garments (Top) made from the same imported material against the advance authorization in question. The case has been examined by DC (MSME) and based on the facts; they have sent their written comments vide their U.O No. 37(5)/74/2010- 11/Hosy. dated 10.03.2011.
