It was decided to defer the case for re-listing on 09.09.2010.

M/s Shahi Exports Pvt. Ltd., New Delhi F.NO.1/84/162/550/AM10 -DES-V Clarification on points mentioned in General Note No.14 of Textiles Product – reg. Decision: The Committee considered the case as per agenda alongwith other relevant papers and perused the observations of Policy Division informing that ‘ however in case the Customs duty and interest and the applicable penalties is paid in terms of Para 4.28 of HBP (Vol.1) for the imported items, then the clause 14 of General Note for Textiles is not attracted.’ The Committee felt that exit from advance authorization scheme also waives all the conditionalities of advance authorization, hence General Note for Textiles condition No. 14 shall also not attracted. It was therefore, decided that as reference was made by NC-V, case is to be examined & decided by Policy Division on Policy angle. Hence, decided to refer back this case to Policy Division.

Case No. 179

Reference from PC-IV Section F.NO.1/84/162/145/AM11 -DES-V Clarification on export item Canvas Tent under DEPB entry S.No.68. Decision: The Committee considered the case as per agenda and perused the ITC (HS) Book. It was observed that under Chapter 63, there are three categories of goods (i) OTHER MADE UP TEXTILE ARTICLES (ii) SETS and (iii) WORN CLOTHING AND WORN TEXTILE ARTICLES; RAGS. Heading 6301 to 6307 covers first category of goods i.e other made up textile articles. Heading 6308 covers second category of goods i.e Sets and heading 6309 to 63010 covers third category i.e Worn clothing and worn textiles articles; rags. The Committee also perused the DEPB entry schedule at S.No. 68 and observed the description of goods is as under: -

‘Yarn dyed/ Processed Cotton Made ups including quilted cotton made ups with or without embroidery and /or with or without metalized yarn.’

The technical representatives of the Committee felt that Canvas is a type of cotton fabric; hence, Canvas tent made out of cotton is covered under DEPB entry schedule at S.No. 68. It was therefore, decided to refer the case to DEPB Committee for taking final decision in the matter.

Case No. 180

M/s Arvind Products Ltd. Ahmedabad F.NO.1/84/50/216/AM09 -DES-V

PRO version Re-fixation of input output norms in respect of Advance Authorization No. 0810083511 dt. 12.10.2009 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda and went through the details submitted by the firm. The Committee after detailed deliberations in consultation with the representatives of technical authorities present in the meeting decided to ratify the advance authorization issued in this case as detailed below: - Export item Import item Qty. allowed Chemically treated flame retardant woven fabric of cotton containing 85% or more by weight of cotton, GSM-200+/-10% Cotton dyed fabric 109377.450 Kgs. Organic phosphorous compound (Pyrovatex –CP New) @ 302 grms per Kg content of the export product. The import of Dyes and Chemicals shall be restricted to 14% of FOB value within the overall CIF value of the licence in terms of General Note for Textiles at S.No.5. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

Case No. 181

M/s Commit Industries Ltd., Mumbai F.NO.1/84/162/176/AM11 -DES-V Ratification of input output norms in respect of Advance Authorization No. 0310572848 dt. 05.05.2010 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in this case export Qty. for item No.1 is 1296 Kgs whereas Qty. asked for import item No. 1 is 560 Kgs. (less than half of export item Qty.). Similarly, in the 2nd item export Qty. is 6200 Kgs and Qty. of import item No. 2 asked for is 2678 Kgs (less than half). Committee felt that it is not possible to manufacture the export item with less than half Qty. of import item. Further, firm have also neither given segregated Qty. for gold metalized/silver metalized/polyester coating film nor mentioned that gold/silver metallized coating is on single side or on both side of the export item. In

PRO version absence of the above details, it is not possible to compute the requirement of inputs in this case. Hence, Committee was constrained to reject the case.

                      RLA may take suitable consequential action accordingly.

Case No. 182

M/s Saati India Pvt. Ltd., Mumbai F.NO.1/84/50/30/AM11 -DES-V Ratification of input output norms in respect of Advance Authorization No. 0310571928 dt. 29.04.2010 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details/information submitted by the firm. The Committee after detailed deliberations in consultation with the representatives of the technical members present in the meeting decided to ratify the advance authorization issued in this case on repeat basis as detailed below: - Export item Qty. Import item Qty. allowed Saatfill Acoustex coloured polyester mesh (thickness 0.048mm to 0.125 mm, width – 130mm to 1000mm) 1 Sq mtr. Relevant Saatfill Acoustex coloured polyester fabric (Thickness 0.048mm to 0.125mm, width-1200mm) 1.05 Sq mtr. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.
