It was also observed that firm’s reply does not pertain to the items of import, which were not allowed i.e Hydrogen Peroxide, Softening Agent, Reactive/direct/or vat or sulphur dyes and Optical- whitening agent. However, the latest amendments made in this case submitted by the firm have been taken on record. The Committee felt that without justification and specification in respect of import item no. 2 to 5, it is not possible to allow the same. Hence, it was decided to maintain status quo in this case.

M/s Alpine apparels Pvt., Ltd. F.NO.1/94/180/1093/AM08 -DES-V Clarification on import under leather group of SION under Target Plus License. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh I.J.Madan, an authorized representatives of the firm, who appeared for personal hearing in this case. He explained that imported yarn is converted into fabric of desired width and density and cut to size of glove and stitched with leather as inner lining. Thus, leather gloves are manufactured and exported. The technical members of the Committee observed from the sample submitted by the firm that technically it is not possible to determine the nexus between imported raw material and export product. Further, there was no technical person of the firm present in the meeting to explain the case. Hence, it was decided to reject the case. Firm may be informed accordingly.

M/s J.K.M Overseas Pvt., Ltd. F.NO.1/84/162/290/AM08 -DES-V Clarification on Policy/Handbook Procedure on DEPB Scheme. Decision: The Committee considered the case as per agenda and perused the Minutes of DEPB Committee meeting held on 30.06.2008. The Committee after deliberations in consultation with representatives of technical authorities present in the meeting re-examined and observed that Quilts is made-ups and qualify the DEPB entry of Silk made-ups or silk including the cover & filling material is 95% or more. The filling material has to be restricted. Ordinarily, Silk being costlier material used as filler material and without which it does not give the quilting property. It was decided to refer the case to DEPB Committee for taking final decision in the matter.

Case No. 1 M/s Chelsea Mills, New Delhi F.NO.1/84/50/233/AM07 -DES-V Refixation of input output norms in respect in Advance Authorization No. 0510175922 dt. 07.02.2006. Decision: The Committee considered the case as per agenda and perused the comments received from DC (MSME) vide their U.O dated 20.08.2008, to whom case was referred for their re-examination. It was observed that the size of the export items are almost same, but these items are made from different fabrics with different fabric width. As per CADs submitted by the firm, the width of 100% cotton denim fabric is 1.50 mtrs and the width of 100% cotton dyed fabric is 1.42 mtrs. and required length of garment has been considered as 0.92 mtr. The sweep is 47” and 1.33 mtr wide fabric is required for manufacture of one garment. So, when, this garment is cut from 1.5 mtr width, 17 cms fabric will remain unused and it will be wastage and when this garment is cut from 1.42 mtrs width, 09 cms fabric will remain unused and it will be wastage. So, in this case, more wastage allowance to the firm is for 1.5 mtrs width fabric. Otherwise, the Qty. of fabric may be restricted to 1.31 sq per piece for 2nd export item also. Therefore, there is difference in total Qty. allowed for both the styles in this case. In view of this, Committee decided that the Qty. allowed is adequate. Hence, it was decided to maintain status quo in this case.
