Please Note For information of exporters, Norms Committee - I handles all cases pertaining to fixation/ratification of norms for Export Products falling under ITC (HS) Chapter 81 to 84, 86 to 93 .Communications in respect of cases/pertaining to NC- I may be sent to email address: nc1.dgft@nic.in I. The Norms Committee has taken decision only with respect to technical aspect/wastage norms. While redeeming the applications, RAs should check that the applicant has fulfilled all requirements as prescribed in policy/procedure including those in Policy Circulars issued from time to time or any other provisions under FTP/HBP for EODC. II. Wherever the Committee has fixed Norms, the concerned RA may ensure that AA is issued on the wastages/consumption as ratified by the Committee or as per wastages claimed in the application, whichever is less. Deferred Case history: The applicant has stated that they are a 100% Export Oriented Unit having letter of permission (LOP) No. KASEZ/100%EOU/II/08/09-10/11623 dated 23.11.2009 are the Member of EPC for EOUs and KSEZs. The applicant has stated that the company is an EOU unit and it is registered with Kandla Special Economic Zone (KASEZ) and there is a requirement by KASEZ that EOU unit needs to fix the norms of its export product. The applicant vide their representation dated 11.01.2020 had requested for fixation of input/output Norms for the import/export products. The copy of application was sent to MSME on 08.09.2020 for examination of the case. As per comments of MSME received via email dated 16.06.2021, a deficiency letter was sent to the applicant on 13.08.2021 for furnishing the following information: A copy of complete set of application. 1. To provide MSME-DI wastage/SEZ wastage report, if any. 2. As per NC decision, a deficiency letter as raised by MSME was issued to the applicant on 27.09.2021. The applicant via email dated 28.09.2021 informed that their unit is not registered under MSME Act, 2006. Therefore, they do not have any MSME-DI wastage report issued by MSME Authority and also such wastage report is not issued by KASEZ Authority. In this regard it has enclosed the letter dated 16.11.2011 of the RA, Bangalore whereby it was informed that its above case for fixation of norms was rejected by NC in its Meeting No.31/80-ALC2/2007 dtd.30.10.2007 (Case No.25/8/80-ALC2/2007). Vide the said letter the RA, Bangalore had requested the firm to regularize the case as per para 4.7.5 of HBP Vol.I 2009-2014 by payment of duty plus interest on the entire import to customs and by payment of fee equivalent to 3% of CIF value of goods imported to the RA, Bangalore. The firm has not submitted the copy of the minutes nor it is available in the current record. The case was rejected in October 2007 and now the firm has approached after about 16 years for review of earlier decision.
2. In support of submitting the application manually, the firm has stated that it has checked online for filling online application but the AA No. is not showing on DGFT portal. The firm has further stated that it has already fulfilled its export obligation and its case is pending for redemption. In addition, the firm was closed in 2016. 3. The matter was referred to Tech-3 for examination and comments vide mail dt.22.07.2024. The case was last considered in NC-1 meeting dt.
