Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that as regards imported item, there is no further process thereon. The Committee also perused the definition of ‘Manufacture’ given in Para 9.37 of Foreign Trade Policy and found that re-packing would be considered as manufacturing. However, it was felt that imported item is not merely re-packed as other finished items are also added to this. It was also noted that firm have referred their earlier case of 2005 and ALC decision on identical case in meeting No. 27/84 dated 06.10.2005, HQ. File No. 01/84/50/396/AM06 against A/A No. 0310347226 dated 13.09.2005. In view of the above Committee decided to link the above referred HQ. (i) Size-wise specification mentioned on both the export item in the NC minutes of meeting held on 10.08.2006 may be deleted and Style No. mentioned in export item No. 2 i.e 5066 may be amended to read as 5067. (ii) The Qty. of both the item of import allowed earlier i.e 3.04 Sq mtr/Pc may be amended to read as 3.70 Sq mtrs./Pc for the item of import. (iii) The four months condition as per Public Notice No. 37 dated 23.08.2007 in submission of reply is condoned in this case.

M/s RSWM Ltd. Bangalore F.No. 01/84/50/497/AM-07/DES-V Re-fixation of input output norms against Advance Authorization No. 0710049951 dated 05.02.2007 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in NC meeting held on 22.05.2008, indeed, the input output norms for second export item were not fixed. The Committee felt that it appears that ALC decision would be based on cue from SION. It was also observed that in this case applicant firm have neither given CAD, CAM, Laymarker and calculation sheet nor justifying the requirement of inputs. Further, firm have not mentioned justification for requirement of each inputs (export item-wise) i.e which item of import is used for which item of export. In view of this, Committee decided to advise the firm to furnish CAD, CAM, Laymarker and calculation sheet alongwith justification for requirement of each inputs to reconsider this case. The case stands deferred for re-listing on 05.03.2009.

Decision: The Committee considered the case as per agenda and observed that earlier NC had decided this case as per SION, G-45 and other three cases (I. Advance Authorization No. 0610011762 dated 23.02.2007, II. Advance Authorization No. 0610012156 dated 27.07.2007 and III. Advance Authorization No. 0610012285 dated 10.09.2007) of applicant firm as per SION, G-45 and G-7. Now, firm have represented that as per SION, G-45, Processing Chemicals are not permissible, whereas they have asked for the same against the A/A in question. The Committee recalled that a Public Notice No. 82(RE: 2008)/2004-2009 dated 17.09.2008 has been issued for computation of requirement of processing chemicals on 17.09.2008. In view of this, Committee in consultation with the representatives of technical authorities present in the meeting decided to ratify all the Advance authorization Nos. referred above issued to the firm as per Public Notice No. 82(RE: 2008)/2004-2009 dated 17.09.2008 for allowing Processing Chemicals.

(ii) Against export item No. 1, the Qty. allowed earlier for the import item No. 10 i.e 0.25 Sq mtr/Pc, Committee felt that the same is adequate. Hence, no change is possible. Further, as regards width condition, Committee decided to remove the same from the description. (iii) Trims & Embellishments may be allowed on net to net basis.
