The Meeting No. 50/AM-10 for the licensing year 2009-10 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 11.03.2010 in Room No.108 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. The Committee felt that ITC (HS) code mentioned in this case for the export item in question is not correct. Hence, Committee was therefore constrained to reject the case. Therefore, Committee was constrained to maintain its earlier decision of rejection.

M/s Poineer Calicos Products Pvt. Ltd., Pune F.NO.1/84/162/282/AM10 -DES-V Re-fixation of input output norms against advance authorization No. 03110038965 dated 23.06.2009. Decision: The Committee considered the case as per agenda and observed that the case is under examination of DC (MSME). In view of this Committee decided to defer the case for re-listing on 08.04.2010. Outside agenda case Case No. 1 M/s Fashion Accessories, Gurgoan F.NO.1/85/50/6/AM10 -DES-V Re-fixation of input output norms in respect of Advance Authorization No. 0510239553 dt. 09.04.2009 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda and observed that this case was earlier decided by NC on

Thereafter, firm represented thereon stating that in this case there are total five export items whereas norms were fixed only for four export items, hence, norms for one more export item i.e “Twin Quilt” have been left over. The representative of the firm Sh. Dinesh Mittal, who appeared for personal hearing before Norms Committee alongwith relevant details informed that norms fixed for “King Quilt (Size 108”x92”) i.e 7.89 Sq mtrs./Pc are also on lower side. He explained that for “King Quilt” (Size 108”x92”), the imported silk fabric is to be used in the back of the King Quilt. As per design of the finished product during threading over quilted surface, the fabrics submerged/gathered and to maintain the finish size of 108”x92”, hence, it should have the back panel of size 120”x100”. As a result of which the cotton fabric front consumption is approx. 8.90 Sq mtrs and because it is in 108” width, therefore actual consumption of Silk is of 10.439 Sq mtrs/Pc in respect of “King Quilt (Size 108”x92”). It was observed that as fabric width is to maintain 54” and big panel is used in the middle, wastage would be more. The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting felt that in order to maintain the specific design (width-wise) the quantitative requirement of fabric for “King Quilt (Size 108”x92”) would be more. It was therefore decided to enhance the Qty. from 7.90 Sq mtr./Pc to 10.439 Sq mtrs/Pc in respect of “King Quilt (Size 108”x92”) i.e as applied by the firm. Further, Committee also felt that as regards “Twin Quilt (Size 68”x86”) the Qty. asked for i.e 4.9 Sq mtrs./Pc is adequate. Thereafter, firm represented thereon stating that in this case that norms fixed for export item i.e “King Quilt” (Size 108”x92”) i.e 7.89 Sq mtrs./Pc are very less. The representative of the firm Sh.
