The Meeting No. 27/AM10 for the licensing year 2009-10 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 01.10.2009 in Room No. 04 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC Meeting No. 18/AM10 dated 30.07.2009, 19/AM10 dated 06.08.2009, 20/AM10 dated 13.08.2009, 21/AM10 dated 20.08.2009, 22/AM10 dated 27.08.2009, 23/AM10 dated 03.09.2009, 24/AM10 dated 10.09.2009 and 25/AM10 dated 17.09.2009 were ratified.

Thereafter, Agenda for individual cases for Meeting No. 27/AM10 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

The Committee also noted that in the application Style No. of export item mentioned is 706342 whereas in the sketch submitted in this case there is no style No. but Merch. No.28984 RGWS10. In view of this Committee decided to advise R.A to call for style

A copy of said report of team is also enclosed. The weight of Plastisole should match on both the side of export & import.

Reference from CAPAXIL in respect of M/s Ke-Technical Textiles, Kolkata NC27/10 dt. 01.10.2009 F.NO.1/84/162/11/AM10-DES-V Fixation of SION for Tubular Bags Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that CAPEXIL has forwarded the application for fixation of SION for Tubular Bags. It was also observed that M/s Ke- technical Textiles, Kolkata have also raised the issue that although TC, Mumbai had recommended a total 10% wastage in this case, NC decided by allowing 8% wastage only. In view of this, Committee felt that the views/comments of TC, Mumbai, a technical authority, is recommendatory in nature. The Norms Committee is composed of other various technical authorities of various Ministries/Deptts. The comments given by the various

PRO version technical authorities are recommendatory & are not binding on the NC. NC decide the case taking into account the recommendations of technical authorities, the particulars of a specific case and then arrives at a final decision. With respect to fixation of SIONs for this product, Committee perused the stage-wise wastage involved in the entire process for manufacture of this export product and after detailed deliberations in consultation with representatives of technical authorities present in the meeting felt that a total 6% wastage is adequate. It was also observed that M/s Ke-technical Textiles, Kolkata is only applicant for fixation of SION in this case, whereas for fixation of SION, at least 3-4 firms’ industry data is required. In view of this Committee decided that TEXPROCIL may be asked for their views/comments with regard to industry data of 3-4 firms’ in the prescribed relevant application form. However, if applicant firm is sole manufacturer of this product, the same may be confirmed by TEXPROCIL. It was decided to defer the case for re-listing on 29.10.2009.

Case No. 443

The Synthetic & Rayon Textiles Export Promotion Council, Mumbai. F.NO.1/84/162/322/AM10-DES-V Amendment in the DEPB Sr. No. 46A Product Code 89- reg. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that SRTEPC have not given specific SION No. relating to Non-woven fabrics made out of Manmade fibres in this case. The Committee felt that without any SION No., DEPB rate cannot be fixed. In view of this it was decided that SRTEPEC may be asked to indicate SION No. & a detailed application may be submitted in the prescribed ANF 4C form to process the same alongwith required data. In case, no SION exists of this export product, they may apply for fixation of SION alongwith the industry data of 3-4 different firms’ who are engaged in this manufacturing process. The case may be closed at this stage.

M/s Gulati Exports House, New Delhi F.NO.1/84/162/633/AM09-DES-V

PRO version Ratification of input output norms in respect of Advance Authorization No.0510232495 dt. 12.12.2008 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance authorization issued in this case on the basis of written comments of DC (MSME) conveyed vide their U.O No.37 (5)/80/2009-10/Hosy dated 29.09.2009 as detailed below : - Export item Import item Quantity allowed. Qty. to be accounted in export Knitted Ladies Top made out of single Jersey knit fabric 65% Polyester 35% Rayon fabric, GSM- 165+/-10%. M/s Chelsea Mills, New Delhi F.NO.1/84/50/299/AM09-DES-V Ratification of input output norms in respect of No.0510226979 dt. 05.09.2008 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that

PRO version this case has already been cleared by NC in its meeting held on 04.06.2009. Firm have now requested that ‘Rivets’ in this case has not been finalized. M/s Chelsea Mills, New Delhi F.NO.1/84/50/385/AM09-DES-V Ratification of input output norms in respect of No.0510231295 dt. 21.11.2009 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case has already been cleared by NC in its meeting held on 01.01.2009. Firm have now requested that against export item No.2 one input has been left out for fixation of norms in this case has not been finalized. M/s Kitex Childrenswear Ltd., Kochi F.NO.1/84/50/26/AM10-DES-V Ratification of input output norms in respect of No.1010033569 dt. 04.05.2009 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that case is under examination of DC (MSME). In view of this case stands deferred for re-listing on 29.10.2009.

Case No. 448

M/s Global Exports, Kanpur F.NO.1/84/162/67/AM10-DES-V Ratification of input output norms in respect of No.0610015105 dt. 10.02.2009 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm have submitted only pattern in this case. They have not given calculation sheet, CAD, measurement etc to compute the quantitative requirement of input in this case. Hence, not possible to fix the norms. It was therefore decided to maintain status quo in this case.

M/s J.D. Jones & Co. Pvt. Ltd., F.NO.1/84/50/53/AM10-DES-V Ratification of input output norms in respect of No.0210128044 dt. 22.06.2009 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to advise the firm to submit relevant production/consumption data for the last two years duly certified by Chartered Engineer in this case to reconsider it. In view of this case stands deferred for re-listing on 29.10.2009.

Case No. 450

M/s Network Clothing Company (P) Ltd., Tirupur F.NO.1/84/50/454/AM09-DES-V Ratification of input output norms in respect of No.3210039704 dt. 10.02.2009 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the original order has been cancelled by the buyer in this case and new buyer has changed the Style No. to 58880 of the export item i.e ‘Ladies Top’. Accordingly, firm have submitted CAD, Laymarker, Design, calculation sheet and sample. The Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to ratify the advance authorization issued in this case by allowing the input @ 1.39s Sq mtrs./Pc as detailed below:-

M/s Tej Shoe Tech, Agra F.NO.1/84/50/299/AM09-DES-V Re-fixation of input output norms in respect of No.0610011396 dt. 14.11.2006 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed the description of import item at S.No.1 i.e Upper Leather Printed and Coated with Synthetic is a broad heading whereas composition leather (Natural Leather with synthetic fibre) is a specifically accepted description. In view of this, Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to advise R.A to accept the same based on the affidavit given therein and accordingly finalise this case as per NC decision already taken. The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.
