Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that as per R.A report this case has since been closed, hence, it was decided to withdraw this case from agenda.

M/s Arvind Products Ltd. Ahmedabad NC No.45/AM11 F.No.01/84/50/143/AM10/DES-V

PRO version Dated 03.02.2011 Ratification of input output norms in respect of Advance Authorization No.0810083511 dated 12.10.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh.Aviram Keshava, Head, Export (Commercial) in the firm, who appeared for personal hearing alongwith one technical person before Committee. It was observed that this case was earlier decided by NC with condition of specific GSM i.e 200+/-10%. The representative informed that the consumption and wastage of Chemical follow the same proportion across all GSM of fabric and for manufacture of Flame Retardant woven fabrics made out of cotton dyed fabric, they are using GSM range from 180 – 400 in order to match with buyers order, hence, imposition of specific GSM condition i.e 200+/-10% should be deleted in this case. It was explained that in the process when particular GSM is put into the process, approximately 7-8% weight is gained on the imported fabric on account of Chemical addon on them. Accordingly, Committee felt that in this case export Qty. shall be enhanced from 104169 Kgs to 112502 Kgs. Further, Committee also felt that import Qty. of fabric is also asked on weight basis likewise Chemical in this case, hence, specific GSM condition may be deleted. Therefore, the GSM of import and export item should match within variation of +/-10%. Accordingly, the Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to rectify its earlier decision as detailed below:- Export item Export Qty. Import item Qty. allowed Chemically treated flame retardant woven fabric of cotton containing 85% or more by weight of cotton. 112502 Kgs Cotton dyed fabric 109377.450 Kgs. Organic phosphorous compound (Pyrovatex – CP New) @ 302 grms per Kg content of the export product. The import of Dyes and Chemicals shall be restricted to 14% of FOB value within the overall CIF value of the licence in terms of General Note for Textiles at S.No.5. As regards amendment in General Note for Textiles at S.No.5, representative was advised to submit entire consumption production data for the last two years upto January, 2011. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

Reference received from PC-IV (B) in respect of M/s Munib Overseas Corporation, Kanpur NC No.45/AM11 F.No.01/84/162/196/AM11/DES-V

Outside agenda case

Case No. 1 M/s Aditya Birla Nuvo Ltd., Kolkata NC45/11 dt. 03.02.2011 F.NO.1/84/162/90/AM11 -DES-V Fixation of SION for Woollen blended Worsted yarn made from Wool Tops and Acrylic Tops Decision: The Committee considered the case as per agenda alongwith other relevant papers and perused the report of Norms Committee team of officers, who had visited the unit of the applicant firm to study the manufacturing process. The data forwarded by the Wool Industry Export Promotion Council, Mumbai as well as applicant firm based on their log book were also taken into consideration for finalizing the report. The report of NC team has been taken on record based on visit to factories of (i) M/s Aditya Birla Nuvo Ltd.(ii) M/s Ke-Technical Textiles Pvt. Ltd., Kolkata. It was observed that woollen blended worsted yarn is manufactured from wool tops & acrylic tops by maintaining homogeneity in both fibre ratio and shade of the material as per required specifications according to the end use. In the manufacturing, wastage occurs during gilling (2-3%), combing (2%) and spinning (2-3%). About 4% wastage is noticed in other manufacturing activities in addition to the above. Hence, Committee felt that total 10% wastage is reasonable for each import item i.e wool tops and acrylic tops. Accordingly, Committee after deliberations in consultation with the representative of technical authorities present in the meeting decided to recommend for a SION for Woollen blended Worsted yarn made from Wool Tops and Acrylic Tops as detailed below: - Export item Quantity Import item Quantity allowed
