It was also informed that metallic fittings are of Steel and Aluminum but segregated Qty. of the same has not been mentioned. Further, against metallic fittings, firm have mentioned various accessories viz., Scaffold hook, snap hook, karabiner rope grab, pipe anchor tower hook, rebar hook, carabiner, ascender, descender, pulley, swivel hook, roof anchor but their specific number has not been mentioned. Net Qty. of Polyester yarn to be used in the export item has not been given. It was informed that against this advance authorization in question, firm have not made any export so far. The representative of the firm was also convinced and assured to do the needful in the matter. In view of this Committee after deliberations in consultation with the representatives of technical authorities present in the meeting advised the representative of firm to submit complete details in view of above observations of NC at the earliest so that Committee can take appropriate view for fixation of norms in this case as well as for future advance authorization. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. M.Najmi, Partner in the firm, who appeared for personal hearing in this case. The Committee observed that this is a reference from PC-IV (B) Section for seeking clarification with regard to eligibility of various export product viz., cotton check sheet. Cotton check pad, cotton traveling boot, cotton winter rug and cotton leg protector – for DEPB rate schedule at S.No. 72, articles made of supreme halter made of polypropylene- for DEPB rate schedule at S.No. 13 and P.P tapes with U.V stabilization 2% by weight plain/fabricated (a) P/P poly pad (b) poly traveling boot – for DEPB entry S.No. 40 of export product group ‘plastics’. The representative showed sample of each item & explained about the saddlery use of each. It was observed that some items were made of polyester but all for saddlery use. It was also observed that in this case applicant firm had filed an appeal against the cancellation order of Jt. DGFT, Kanpur in terms of 6 DEPB licences, which were ab-initio on the basis that the product actually exported and shown in sub-head was not according to the main description and hence they were not eligible for the DEPB. The Appellate Authority, HQs has set aside the Order passed by Jt.DGFT, Kanpur in this case. In view of the above position, the Committee after deliberations in

M/s Chelsea Mills New Delhi NC No.31/AM11 F.No.01/84/50/151/AM10/DES-V Dated 28.10.2010 Authorization No.0510251522 dated 27.10.2010 Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. Anil Kumar, an authorized representative of the firm, who appeared for personal hearing in this case alongwith one technical person. They showed sample in this case. It was observed that this case was cleared by NC in its meeting held on 03.12.2009 but tape and pumice stone were disallowed due to the fact that export product is not made out of denim fabric. The representative explained that against export item No. 1, pumice stone is used to create softness by beating process for 90 minutes and against export item No. 1 & 3 tape is used to draw string in the bottom fold of pant to facilitate the wearer to tighten the bottom. This tape is on the front & back yoke and side front pockets.
