The Meeting No. 15/AM-11 for the licensing year 2010-11 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 08.07.2010 in Room No.213 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. DGFT. The following officers were present: -

Hence, Committee felt that it is difficult to monitor the export item in number/pairs. In view of this it is not possible to fix the norms. Therefore, Committee was constrained to reject the case.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that earlier during personal hearing before NC, the representative of the firm, who had attended the meeting was clearly advised to indicate the fabric width on each export item and the same should be incorporated on the export side in the future advance authorization for consideration of Norms Committee. It was observed that applicant firm have failed to comply with the instructions of NC. In view of this, Committee was constrained to reject the case. In future, Committee will not consider this case without incorporation of width of fabric on export side.
RLA may take suitable consequential action accordingly.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm have merely given sketch of export item bearing style No. 1J1267. They have neither given CAD/CAM, Calculation sheet, Measurement nor size-wise specification of each export item alongwith justification for asking higher quantitative requirement. In view of this Committee in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case detailed below: -
PRO version (i) The import item at S.No. 1, 5 and 6 against export item No. 1, 2 & 3 respectively may be allowed @ 2.45 Sq mtrs./Pc. (ii) The item of import at S.No. 2, 3 & 4 against export item No. 1 may be allowed as applied for in this case.
The GSM should match in both import & export. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

M/s Meenakshi India Ltd., Chennai NC 15/11 dt. 08.07.2010 F.No. 01/84/50/283/AM-04/DES-V Re-fixation of input output norms against Advance Authorization No. 0410041075 dated 22.05.2003 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and decided to call for a copy of complete set of original application submitted by the firm in this case. Further, it was also decided to advise the applicant firm to submit copy of shipping bills, invoices and other relevant documents which can corroborate the consumption of fabric as requested by them to reconsider the case. It was therefore decided to defer the case for re-listing on19.08.2010.

Reference received from PC-IV(B) enclosing therewith reference from Jt. DGFT, Baroda NC 15/11 dt. 08.07.2010 F.No. 01/84/162/140/AM-11/DES-V DEPB claim for export of Mattress Tape under DEPB schedule entry No. 47A. Decision: The Committee considered the case as per agenda and observed that PC-4 (B) Section have sought clarification as to whether the export product “Mattress Tape” is covered under S.No. 47A of DEPB Rate schedule under Product group Textiles (Product Code 89). The Committee observed that in this case export item is 100 Mts. long and 30 mm wide tape made of man made filament yarn and firm has claimed DEPB under fabric category. The technical members of the Committee felt that in normal parlance, fabric range is 120cm – 230 cms or higher and fabric width is 36” (minimum) upto 90” or higher. Hence, only this range of width can be classified as fabric. DEPB Schedule at 47A is meant for fabrics, whereas export product in this case is Mattress Tape having width 30mm and technically Mattress Tape is value added products made out of fabric and cannot be classified as fabric. In view of this Committee was of the view that export item Mattress Tape in this case is not fabric and cannot be covered under 47A of DEPB rate schedule. Therefore, it was decided to inform PC-4(B) Section accordingly.

DGFT, Kolkata NC 15/11 dt. 08.07.2010 F.No. 01/84/162/187/AM-10/DES-V Policy relaxation of General Note No.14 of Textiles Product of DFIA licenses issued to seven different cases- reg. Decision: The Committee considered the case as per agenda and observed that AEPC vide their letter dated 16.06.2010 have sent their comments in the matter, which have been taken on record. It was decided to refer the recommendations of AEPC to DC (MSME) for their examination and comments thereon. The case stands deferred for re-listing on 05.08.2010.

Decision: The Committee considered the case as per agenda and observed that applicant firm have not given details of measurement and complete justification for review of this case, in absence of which it is not possible to consider this case. Hence, decided to maintain status quo in this case.
