The Meeting No. 11/AM-12 for the licensing year 2011-12 to consider the cases under Duty Exemption Schemes (Chapter-4) due for 16.06.2011 but actually held on 23.06.2011 in Room No.213 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. DGFT. The following officers were present: -

Case No.47 M/s G.R.Corporation, Kanpur NC No.11/AM12 F.No.01/84/50/306/AM11/DES-V Dated 16.06.2011 Ratification of input output norms against advance authorisation No. 0610019649 dated 09.11.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that earlier this case was cleared by NC as per written comments of DC (MSME). Now, firm have requested for inclusion of 8th additional export item i.e Vulcanised rubber thread and cord, which was earlier not mentioned in the application. Further, they have also mentioned that some export items allowed earlier are not made in combination with rubber thread, whereas in their application, it was not so. In view of the above Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to advise the applicant firm to submit their revised application as desired by them explaining as to how the Qty. of each import item would be accounted for in each export item to reconsider this case. Firm may be informed accordingly.

Case No.48 M/s JCT Ltd., Phagwara NC No.11/AM12 F.No.01/84/50/202/AM11/DES-V Dated 16.06.2011 Re-fixation of input output norms against advance authorisation No. 3010069298 dated 03.09.2010. Decision: The Committee considered the case as per agenda alongwith other papers and observed that case is under examination of DC (MSME) and comments are awaited. It was therefore decided to defer the case for re- listing on 21.07.2011. Case No.49 M/s United Electrotex Pvt. Ltd., Bangalore NC No.11/AM12 F.No.01/84/162/274/AM08/DES-V Dated 16.06.2011 Re-fixation of input output norms against advance authorisation No. 0710051672 dated 17.05.2007. Decision: The Committee considered the case as per agenda and heard Sh. N.S.Bhaskaran, Manager (Logistics) in the firm, who attended the personal hearing before NC meeting. He explained the case alongwith relevant documents pertaining to the case. It was observed that earlier this case was cleared by NC in its meeting held on 02.04.2009 by allowing three export items i.e ‘Men’s Pants’, ‘Ladies Pants’ & ‘Men’s Shirts’(as per relevant SIONs) and 4th export item i.e ‘Hang bags’ was not allowed. It was now informed that due to change of buyer’s order, firm had exported Ladies Shorts (2678 Pcs) and ‘Ladies Skirts’ (535 Pcs) in place of ‘Ladies Pants’ (2400 Pcs) made out of the same fabric, hence requested to allow the same as per relevant SION. The Committee also observed that for export item ‘Ladies Shorts’-SION, J-292 and for ‘Ladies Skirts’-SION, J-289 exist. Case No.50 M/s Welspun India Ltd. Mumbai NC No.11/AM12 F.No.01/84/162/481/AM11/DES-V Dated 16.06.2011 DEPB claim under S.No. 68 (Code-89 –Textile Group) on export of rugs falling under Chapter 57- reg. Decision: The Committee considered the case as per agenda and heard Sh.S.Suryanaraynan, Sh.Vimal Kumar Sharma, GM (Commercial) in the firm, who attended personal hearing before NC in this case. The representatives of the firm were advised to mention specific SION under which the description of their export product in question falls. The Committee, therefore, advised the representatives of the firm to submit their reply specifying SION of their item alongwith justification as to how the same is covered under that SION. It was therefore, decided to replace this case before NC only on receipt of the same. Firm may be informed accordingly. Case No.51 M/s Gulati Export house, New Delhi NC No.11/AM12 F.No.01/84/162/243/AM05/DES-V Dated 16.06.2011 Re-fixation of input output norms against advance authorisation No. 0510123638 dated 19.04.2004. Decision: The Committee considered the case as per agenda alongwith other papers and went through the technical details viz., CAD/CAM/drawing/design & manufacturing process etc submitted by the firm in this case for seeking

It was observed that in this case export items i.e. ‘Ladies Cordroy jackets’ are having large yok at the back (double layer) and there are two patch pockets, hence, consumption of fabric more than that of normal jacket is justified. Decision: The Committee considered the case as per agenda alongwith other papers and went through the technical details viz., CAD/CAM/drawing/design & manufacturing process etc submitted by the firm in this case for seeking enhancement in the Qty. of inputs allowed earlier in this case. Ltd.,Kolkata NC No.11/AM12 F.No.01/81/50/356/AM10/DES-V Dated 16.06.2011 Ratification of input output norms against advance authorisation No. 0210134949 dated 08.12.2009. Decision: The Committee considered the case as per agenda alongwith other papers and observed that NC team has already visited the unit of the firm and supporting technical data called for therein from firm for finalisation of report has since been received and under examination of DC (MSME). It was therefore decided to defer the case for re-listing on 21.07.2011.

Case No.54 M/s Kanak Exim, Chennai & Reference received from Deptt. Of Revenue Drawback Division NC No.11/AM12 F.No.01/84/162/18/AM12/DES-V Dated 16.06.2011 Request for clarification on import of Sodium Tripolyphosphate (STPP) as ‘Masking agent’ under chrome tanned leather under SION, G-7– reg. Decision: The Committee considered the case as per agenda alongwith other relevant papers and perused the written comments of DIPP conveyed vide their letter dated 16.06.2011. It was observed that Sodium Tripolyphosphate (STPP) has several uses and one of the functions is to act as a Pre-tanning agent/Masking agent. The Masking agent is a Chemical when it is added to Chrome liquor, it raises the precipitation points, buffer the situation i.e to control the pH and reduce the Tanning affinity of the Chrome. Thus, Chrome (tanning agent) gets

The Committee also felt that the synthetic tanning substances are covered under 32021000 whereas Sodium Tripolyphosphate (STPP) is covered as separate Chemical entry under exim code 28353100. Further, the ITC (HS) code 3202 is a main heading covering both organic and inorganic tanning substance. The Committee felt that Sodium Tripolyphosphate (STPP) is an inorganic substance and is used as pre tanning agent. The Committee also perused that the description of import item at S.No. 12 (a) (i) under SION, G-7 (export item - Finished Leather from Hide of Cow / Buffalo) is as under:
