The Meeting No. 23/AM-12 for the licensing year 2011-12 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 8.9.2011 in Room No.11 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. DGFT. The following officers were present: -

Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Ms. Maikal
Raorani, Director of the firm, who appeared for personal hearing before NC. The technical authorities present in the
meeting saw the samples. It was noted that wastage is merely on account of 2 mm each cutting due to sileage. The Narrow
Woven Hook / Loop Tapes were of 18 mm width and the width of roll ranged from 125 mm to 130 mm. This results in a
wastage of around 3.5%. Further the width mentioned on import side be modified as “125 mm to 130 mm” and on export side

No.68 (89 – Textile Group) on export of rugs failing CTH/CETH Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted by the firm. The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to felt that tufting is a process of insertion of yarn tuft into the base fabric i.e cotton canvas and cotton rugs (tufted) are used as textile floor coverings. The Committee also perused the Note No. 7 of Section XI of Chapters 50 to 63; the expression ‘made up’ means the following: - (a) Cut otherwise than into squares or rectangles; (b) Produced in the finished state, ready for use (or merely needing separation by cutting dividing threads) without sewing or other working (for example, certain dusters, towels, table cloths, scarf squares; blankets); © Hemmed or with rolled edges, or with a knotted fringe at any of the edges, but excluding fabrics the cut edges of which have been prevented from unraveling by whipping or by other simple means; (d) Cut to size and having undergone a process of drawn thread work; (e) Assembled by sewing, gumming or otherwise (other than piece goods consisting of two or more lengths of identical material joined end to end and piece goods composed of two or more textiles assembled in layers, whether or not padded); (f) Knitted or crocheted to shape, whether presented as separate items or in the form of a number of items in the length.
PRO version Therefore, Committee taking into consideration the manufacturing process given and interpretation given in Note No. 7 of Section XI felt that Cotton tufted rugs are in ready to use condition, hence clearly classifiable under Made ups category. Hence, it was decided to recommend that export item ‘cotton rugs tufted’ could be classified under DEPB Schedule entry at S.No.68 (Textile Product Group–89) under ITC (HS) Chapter 5703. Accordingly, the case be referred to DEPB Committee for a decision.

After deliberation the Committee decided to allow the amendment in the export item as originally applied for by the applicant i.e. Ladies Shirt (Full Sleeve).
