Minutes of NC-V Meeting held on 14.01.2010
The Meeting No. 42/AM-10 for the licensing year 2009-10 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 14.01.2010 in Room No.04 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. M/s Eastern Silk Industries Ltd., Kolkata F.NO.1/84/50/103/AM10 -DES-V Ratification of input output norms in respect of Advance Authorization No. 0210119991 dt. 20.11.2008 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda and observed that this case was cleared by NC in its meeting held on 03.09.2009 by allowing 35% wastage taking cue from SION, J-123 with amendment in the description of export item to read as ‘Mulberry Raw Silk Twisted Yarn (in gummed form). The Committee felt that if import item is degummed then 5% wastage is adequate but if import item is in gummed form then only 35% wastage is justified. Hence, 35% wastage can be allowed only when import item is in gummed form. Accordingly, Committee decided that description of import item may be amended to read as “Thrown Silk Yarn (Mulberry Raw Silk Twisted Yarn (in gummed form)” in partial modification of its earlier decision. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

PRO version F.NO.1/84/50/209/AM09 -DES-V Ratification of input output norms in respect of Advance Authorization No. 0510219120 dt. 08.04.2008 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda and observed that earlier decision of NC was based on the written comments of DC (MSME). As regards export item No. 3 i.e Girls Dress (Frock), firm have represented that input has been allowed @ 1.23 Sq mtrs/Pc whereas their actual consumption for the same is @ 1.382 Sq mtrs./Pc. The Committee also observed that as per SION, J-313, the fabric is allowed @ 2.50 Sq mtrs./Pc for Girls Frock. In view of this Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to allow item of import against export item No. 3 i.e Girls Dress (Frock) @ 1.382 Sq mtrs./Pc instead of 1.23 Sq mtrs./Pc taking lenient view in this case. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

PRO version 5210028465 dt. 06.10.2009 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda and decided to link with earlier case of the firm wherein similar input output norms have been fixed and defer the case for re-listing on 28.01.2010.

M/s Cheran Spinners Ltd., Erode F.NO.1/84/50/378/AM06 -DES-V Ratification of input output norms in respect of Advance Authorization No. 3210030094 dt. 05.09.2005 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda and observed that applicant firm have not appreciated the NC decision taken on 10.12.2009 in this case. Firm have still not given reply as to how it can be possible that total weight of export item is 5715 Kgs and the net content of Mulbery Silk is also 5715 Kgs in spite of the fact that export item contained Viscose/Mulberry Silk/Wool/Blended yarn. Accordingly, it is not clear as to what is the weight of Viscose/Mulberry Silk/Wool/Blended yarn separately and total weight of export item, in absence of which it is not possible to compute the requirement of input in this case. Hence, the Committee decided to maintain status quo in this case.
Firm may be informed accordingly.
