Minutes of NC-V Meeting held on 04.02.2010
The Meeting No. 45/AM-10 for the licensing year 2009-10 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 04.02.2010 in Room No.213 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. M/s Sky Industries Ltd., Mumbai F.NO.1/84/162/220/AM10 -DES-V Ratification of input output norms in respect of Advance Authorization No. 0310048880 dt. 09.08.2000 – under Para 4.7 of HBP (Vol1) 2004-2009. Decision: The Committee considered the case as per agenda and observed that this case is of the year 2000 and so far no input output norms have been fixed. Therefore, Committee based on available documents and in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance authorization issued in this case as detailed below: - (i) The items of import from S.No.1 to 4 may be allowed as applied by the firm. Since, accountability is already mentioned on the export product, which include 10% wastage, hence reasonable. (ii) The items of import from S.No.5 to 8 may be allowed as per Packing Policy or as applied by the firm whichever is less. (iii) The items of import from S.No.9 to 12 may be allowed as applied by the firm, which is used for making hot melt adhesive.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was earlier considered by NC in its meeting held on 23.07.2009 and clarified that handmade chainstitch woollen 100% wool embroidery, base & back 100% cotton including rugs, durries falling under ITC (HS) code 57023120 and 57011000 would be covered under handmade carpets and other textile floor coverings {covered under Chapter-57 of ITC (HS) Book}. Other ITC (HS) code viz. 63049120 & 63049190 are not covered under Chapter-57 of ITC (HS) Book. The Committee went through the various shipping bills: - 6202165 dated 08.04.2008, 6325203 dated 22.05.2008, 6540751 dated 01.08.2008, 6674215 dated 17.09.2008, 6746622 dated 14.10.2008, 6746722 dated 14.10.2008, 6865878 dated 20.11.2008, 6913441 dated 13.12.2008, 6937106 dated 22.12.2008, 7025007 dated 22.01.2009 and 7025885 dated 23.01.2009. The Committee also perused the ITC (HS) Code under Chapter-57. It was observed that in the shipping bills it has been clearly mentioned that Handicraft: handmade chainstitch woollen 100% wool embroidery, base & back 100% cotton.
