Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to call for the following information/documents from the firm: - (i) Net content of Paulownia Wood in the export product; (ii) Total quantity of import in Cubic Meter.

         It was therefore decided to defer the case for re-listing on 20.08.2009.

In this connection, the comments/views of AEPC called for are still awaited. It was decided to remind them and defer the case.

dated 07.08.2007 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case by

The Committee went through the relevant details submitted by the firm and after deliberations in consultation with representatives of technical authorities present in the meeting, Committee decided to ratify the advance authorization issued in this case as detailed below:

The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting felt that 2.5% wastage is adequate in this case. Hence, it was decided to ratify the Advance Authorization issued in this case by allowing 2.5% wastage on the item of import. The firm have to account for 4271 Kgs of import item in the export product.

The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

dated 29.05.2009 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and went through the Flow Chart submitted by the

The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting felt that 2.5% wastage is adequate in this case. Hence, it was decided to ratify the Advance Authorization issued in this case by allowing 2.5% wastage on the item of import. The firm have to account for 1709 Kgs of import item in the export product.

Case No.298

M/s Bhadresh Trading Corporation Ltd. F.No. 01/84/162/717/AM-09/DES-V Fixation of SION for Raw Cotton not carded or combed. Decision: The Committee considered the case as per agenda and observed that M/o Agriculture (D/o Agriculture & Cooperation) have sough the following information: - (i) Variety of cotton whether hybrid etc. to be imported, (ii) Variety of cotton to be exported and (iii) Area where grown and whether irrigated or not. The Committee felt that cotton grown anywhere in the country can be exported. Accordingly, for fixation of SION for Raw Cotton, some average or minimum Qty. of Seeds, Pesticides/Insecticides/Biocides/Herbicides/Fungicide etc. shall be required. For this, M/o Agriculture can show the relevant data of total production of raw cotton and consumption of Seeds, Pesticides/Insecticides/Biocides/Herbicides/Fungicide etc. Further, Committee also decided to call the similar data from APEDA, ICAR, CIRCOT, Mumbai to take a final view in the matter. It was therefore decided to defer the case for re-listing on 20.08.2009.

Case No.1 M/s Shah Rug International, J & K F.No. 01/91/180/286/AM-10/PC-3 Clarification regarding grant of VKGUY against export of Chainstitch Rugs. this is a reference from R.A Jammu forwarded through PC-3 Section seeking clarification regarding grant of VKGUY against export of Chainstitch Rugs. The Committee went through the various shipping bills: - 6202165 dated 08.04.2008, 6325203 dated 22.05.2008, 6540751 dated 01.08.2008, 6674215 dated 17.09.2008, 6746622 dated 14.10.2008, 6746722 dated 14.10.2008, 6865878 dated 20.11.2008, 6913441 dated 13.12.2008, 6937106 dated 22.12.2008, 7025007 dated 22.01.2009 and 7025885 dated 23.01.2009. The Committee also perused the ITC (HS) Code under Appendix-37 and after deliberations in consultation with representatives of technical authorities present in the meeting observed that handmade chainstitch woollen 100% wool embroidery, base & back 100% cotton including rugs, durries falling under ITC (HS) code 57023120 and 57011000 would be covered under handmade carpets and other textile floor coverings are covered under Appendix-37 of ITC (HS) Book. Other ITC (HS) code viz. 63049120 & 63049190 are not covered under Appendix-37 of ITC (HS) Book. It was therefore
