Case No. 1:  M/s. Shankar Packagings Limited, Mumbai

File No.  01/60/162/542/AM09/EFGC(PRC) PRC Meeting No. 01/AM10 dated: 18.05.2009 Subject: Request for grant of Revalidation & CIF enhancement of Advance Licence No. 0310380233 dt. 12.5.2006 for six months.   The  Committee  noted  from  the  agenda  that  the  firm  has  claimed  to  have  fulfilled  E.O  to  the  extent  of  100%  Qty.  wise  within  valid  EOP. Accordingly, the Committee  decided to revalidate the advance authorisation no. 0310380233 dt. 12.5.2006 for a period of six months from the date of communication of the decision of PRC, subject to payment of composition fee @ 1% of the unutilized cif value of the authorisation and also subject to verification by RA of EO fulfillment status, as claimed by the firm. The request for enhancement in CIF value will be considered by RA concerned.

  The Committee considered  noted that the Ministry of Home Affairs has given No objection to Shri Navin Jindal, EVC & MD of M/s. Jindal Steel & power Ltd. for purchase of above vehicle for his use vide their letter dt. 26./3.2008.  DG has already granted approval on file to Shri Jindal for import of above vehicles in his personal capacity.  The Committee, therefore accorded ex­post facto approval for the same.

  The Committee considered the case as per Agenda.  In light of facts and circumstances, of this case, the Committee decided to permit revalidation of 6 months (i.e. till 30th November, 2009).  Applicant may approach RA for endorsement.

  The Committee noted from the agenda that the firm has claimed to have fulfilled E.O to the extent of more than 50% Qty. wise within valid EOP. Accordingly, the Committee  decided to revalidate the advance authorisation no. 0510184787 dt. 16.06.2006 for a period of six months from the date of communication of the decision of PRC, to enable them to complete their imports on pro­rata basis.  This would be subject to payment of composition fee @ 1% of the unutilized cif value of the authorisation and also subject to verification by RA of EO fulfillment status, as claimed by the firm.

  The Committee noted that EO fulfilled in respect of Advance Authorisation No. 3010048593 dared 08.08.2006 was 20% qty. wise, within valid EOP, as claimed by the firm.  Committee therefore, decided to revalidate the aforesaid advance authorisation for a period of six months from the date of communication of the decision of PRC, subject to payment of composition fee @ 1% of the unutilized cif value of the authorisation and also subject to verification by RA of EO fulfillment status, as claimed by the firm. RA shall reduce the import entitlement on pro­rata basis.

  The Committee noted that export obligation fulfilled was 40.76% within valid EO period and 58.40% outside EOP against advance authorisation no. 2610005076 dated 16.11.2005. The Committee further noted that there was constitutional changes at the buyer’s side wherein the business of M/s. Brisol Myers Squibb (the foreign buyer) had been transferred to M/s. Novartis and for the acceptance of the consignment by M/s. Novartis as per the order placed by M/s. Brisol Myers, it required the approval of M/s. Novartis for the said product. Approval was received by the firm by end of November, 2008. Accordingly, the balance EO of 58.40% could fulfilled only thereafter i.e. outside the EO period (i.e. from 17.11.08 to 06.04.09). The Committee noted that the circumstances were beyond the control of the firm and accordingly, decided to extend EOP upto 17.11.2008 for regularization of exports already made against the aforesaid advance authorisation no. 2610005076 dt. 16.11.2005 subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and outside EOP and subject to the payment of composition fee @ 6% of the duty saved amount for the balance inputs for which exports were completed outside the EOP. After extension, for any balance EO, the firm has to get it regularize by payment of Customs duty and interest.
