Minutes of NC-V meeting held on 01.03.2012

        The meeting No.47/AM-12 for the licensing year 2011-12 to consider the cases under Duty Exemption Schemes (Chapter-

In view of above, the Committee was unable to finalise the norms and constrained to reject the case. RLA may take suitable consequential action accordingly.

Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to ask the applicant firm to send the same for consideration of the proposal. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in the composition of export product, net content of synthetic rubber has not been indicated by the applicant firm. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to ask the applicant firm to send the same for consideration of the proposal. The case is deferred for re-listing on 29.3.2012. (6)

NC 47/AM-12, dt. 01.3.2012 File No.01/84/50/0096/AM-12/DES-V Request for correction in description of import item of Advance Authorisation No. 0210157706 dated 13.04.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that there is a typographical error in the import side at item No.2 of the decision of Norms Committee meeting held on 8.9.2011 in this case. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided that the item No.2 of the import side may be read as under:-

“Coir Sheet needled left with one side natural latex coated size-N 50 x 150 cms.”

RA may take suitable consequential action accordingly.

M/s Karigar, Mumbai NC 47/AM-12, dt.01.03.2012 File No.01/84/50/248/AM-12/DES-V Ratification of Advance Authorization No. 0310430563 dated 24.05.2007 under para 4.7 of HBP. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that export has been done prior to the consideration of the proposal by the Committee. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided that the export made by the firm against the said authorisation

PRO version prior to fixation of ad-hoc norms may be taken into account of the export obligation without insisting on export description modified while fixing ad-hoc norms in this case.

RA may take suitable consequential action accordingly.

M/s A.S. Marimuthu, Vairudhunagar NC 47/AM-12, dt.01.03.2012 File No.01/84/50/159/AM-12/DES-V Ratification of input output norms against Advance Authorisation No.3510034416 dated 21.06.2011 under para 4.7 of HBP. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm has requested to amend the licence in respect of the unit of measurement for import item list in Kgs. term instead of in Nos. term. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting feels that this is typographical error and decided to amend the licence in respect of the unit of measurement for import item list in Kgs. term instead of in Nos. term without change of quantity of import items.

RA may take suitable consequential action accordingly.

Case No.446

M/s Chinar Forge Ltd., Jalandhar File No.01/84/162/156/AM-12/DES-V Cancellation of Advance Authorisation No.3010075641 dated 03.06.2011 in lieu of Advance Authorization No.3010075874 dated 09.06.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm has requested to issue the confirmation of the ratification of input output norms pertains to Advance Authorization No.3010075874 dated 09.06.2011 instead of Advance Authorisation No.3010075641 dated 03.06.2011 as the said authorization was cancelled by

PRO version RA on the request of applicant firm because the application was submitted on Non EDI Port inadvertently. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting is of the view that if the export/import in earlier licence No. 3010075641 dated 03.06.2011 and licence No. 3010075874 dated 09.06.2011 are the same, no approval of Norms Committee is required as the ad-hoc norms are valid for one year. Same norms in this case will apply and will be treated as repeat basis even if the earlier authorization has been cancelled and surrendered and remained unused.

RA may decide and may take suitable consequential action accordingly.

M/s Indorama Synthetic (India) Ltd. File No.01/84/50/248/AM-12/DES-V Ratification of Advance Authorisation No.5010000992 dated 05.10.2011 under para 4.7 of HBP. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in the application, applicant firm has sought the correction in the NC decision taken in its meeting held on 8.12.2011 in item No.10 of the import side i.e. HDPE, PP Granules from 12,800 Kgs. to 1,28,000 Kgs. as the above quantity was indicated in the application form inadvertently. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to call the applicant firm for personal hearing before NC alongwith complete justification and technical person to explain the case. The case stands for re-listing on 12.04.2012.

It was also decided to add following words in the description of export item: - “Containing Canvas Artist Board of Paulownia wood bards in assorted sizes (containing Paulownia wood bards of various sizes – minimum 164.35 CBM). M/s Hitex Healthcare Una, Himachal Pradesh File No.01/84/162/371/AM-12/DES-V Ratification of input output norms in respect of Advance Authorisation No.2210012476 dated 31.01.2012. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm has proposed for export of various products with generalized description:- ‘Garments of non-woven fabrics under Heading 5603’ and import of ‘Non-woven fabric having 25 GSM to 70 GSM (average uses per pcs. 142 grams)’.

In this case, the Committee is of the view that export description is not very product specific. The export description should be the same as export product (say e.g. Pant/Shirt). It is illogical to ascertain the ad-hoc norms in such a manner. Moreover, variation (+/-) in GSM allowed is only 10%. In view of above, the Committee was unable to finalise the norms and constrained to reject the case. RA may take suitable consequential action accordingly.
