Minutes of NC-V meeting held on 07.06.2012 The meeting No.09/AM-13 for the licensing year 2012-13 to consider the cases under Duty Exemption Schemes (Chapter- 4) held on 07.06.2012 in Room No.4 of DGFT under the Chairmanship of Shri A.K. Singh, Jt. DGFT. The following officers were present:-

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm has not given any justification for enhancement of quantity of import item in respect of export item No.3. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided not to allow the additional requirement of import item in respect of export item No.3, on pro-rata basis.

RLA may call back the licence and rectify the import quantity. If they change import quantity on pro-rata basis or as per ad-hoc decision of Norms Committee per piece after working out the requirement.

Case No.230

M/s Givo Limited, Gurgaon NC 09/AM-13, dt.07.06.2012 File No.01/84/162/33/AM-13/DES-V Request for approval to consider export of 2350 Boys Trouser (S/B No.5963991 dated 16.01.2006) towards fulfilment of export obligation of 10,000 Boys Trouser against Advance Authorisation

PRO version No.0510161383 dated 05.07.2005. Decision: The Committee considered the case as per agenda alongwith other relevant papers andit has been given to understand from the application that procurement has been made to procure the woollen fabric from the domestic market. The applicant firm has not given any proof for his buyer that actually the buyer had ordered boys trousers where shell fabric was woollen and received where shell fabric was cotton. The description of the export product is ‘Boys trousers (suit type with lining)’. The Committee could consider the proposal only on such co-related proof. Therefore, the Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to ask the applicant firm to provide such co-related proof so that Committee can consider the proposal. The Committee has decided to defer the case for re-listing on 19.07.2012. (12)

Case No.231

M/s Modern Apparels, Mumbai NC 09/AM-13, dt.07.06.2012 File No.01/85/50/130/AM-12/DES-V Ratification of input output norms in respect of Advance Authorisation No.0310634031 dated 01.06.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in the application, export quantity has been indicated as 108.00 Kgs. The weight of the export product has been given in the description of the export product. The Committee unable to believe that export product alongwith pouch, hood with inbuilt fireman’s helmet, a pair of gloves and a pair of boots, all these items together cannot be 108 Kgs. Certainly the export quantity is 262 Kgs or 370 Kgs. Accountability of 108 Kgs. for making without drawing/design, CAD/CAM, GSM, quantity of coating, it is not possible to compute the requirement of any of the product. Merely mentioning the 108 Kgs of export product on shipping bill, does not account for the requirement of fabric for export product.

The Committee needs to know that for each set of export product, how much quantity of aluminized fibreglass fabric required for each set, what is the GSM of the export product. Without the above details, it is not possible to work out the requirement of import item. In view of above, the Committee was unable to finalise the norms and constrained to reject the case. RA may take suitable consequential action accordingly. (13)

Case No.232

M/s Chelsea Mills, New Delhi NC 09/AM-13, dt.07.06.2012 File No.01/85/50/382/AM-12/DES-V Ratification of input output norms in respect of Advance Authorisation No.0510314084 dated

PRO version 10.01.2012. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm has requested that import item No.1 of all three export product may be enhanced from 1.925 sq. meter per piece to 1.98 sq. meter per piece and import item No.2 i.e. snap fastners may be enhanced from 1 set to 8 set per piece. Therefore, the Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to allow import of snap fastners @ 8 sets per piece on net to net basis with accountability clause.

The Committee observed that in the application, the applicant firm has intimated to attach CAD/Marker for each style. However, the same has not been received in the Department. Therefore, the Committee has decided to maintain status quo in respect of import item No.1 of all three export product. (14)

Case No.233

M/s Chelsea Mills, New Delhi NC 09/AM-13, dt.07.06.2012 File No.01/85/50/374/AM-12/DES-V Request for addition of Style No.734029 - Advance Authorisation No.0510317500 dated 13.03.2012. Decision: The Committee considered the case as per agenda alongwith other relevant papers and surprised to receive the request of the applicant firm. The applicant firm is well aware that in each style number, the requirement of imported fabric can be different unless and untill the applicant firm prove that style number is same, the request cannot be agreed to. In view of above, the Committee decided to call for comparison with the item No.3 sought to be addition of new style number and decided to defer the case for re- listing on 05.07.2012.
