Minutes of NC-V meeting held on 26.04.2012

        The meeting No.03/AM-13 for the licensing year 2012-13 to consider the cases under Duty Exemption Schemes (Chapter-
  1. held on 26.04.2012 in Room No.4 of DGFT under the Chairmanship of Shri A.K. Singh, Jt. DGFT. The following officers were present:-

At the outset, the Minutes of NC-V Meeting No.49/AM-12 dated 22.03.2012 were ratified. The agenda for meeting No.03/AM- 13 dated 26.04.2012 was taken up for discussion and the decision taken in respect of each case is enumerated below:-

MANUAL AGENDA CASES

(1) Case No.47 M/s Niyaz Apparels

PRO version NC 03/AM-13, dt.26.04.2012 File No.01/84/50/423/AM-06/DES-V Ratification of input output norms in respect of Advance Authorization No. 0410074947 dated 28.09.2005. Decision: The Committee considered the case as per agenda alongwith other relevant papers and seen the samples and copies of the shipping bills and has been accounted for in the shipping bill prior to the export. According to samples, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to fix the ad-hoc norms at item No.3 i.e. 100% cotton tape and allowed 2 yard of 100% cotton tape per piece.

(2) Case No.48 M/s CLC Corporation, New Delhi NC 03/AM-13, dt.26.04.2012 File No.01/84/162/304/AM-11/DES-V Ratification of input output norms in respect of Advance Authorisation No. 0510114531 dated 19.01.2004. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to call the applicant firm for personal hearing before NC alongwith sample, complete justification, copy of the earlier decision of NC and reason for delay in submission of representation and technical person to explain the case. The case stands for re-listing on 24.05.2012.

(3) Case No.49 M/s Om Jyoti Apparels, Noida NC 03/AM-13, dt.26.04.2012 File No.01/84/50/289/AM-12/DES-V Ratification of input output norms in respect of Advance Authorization No. 0510309186 dated 24.11.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Mr. Maninder Singh, present before the NC on behalf of the firm. Mr. Maninder Singh had shown some patchwork fabric before the Committee. From the description of the fabric, it is not possible to ascertain whether patchwork has been made or other-wise. The Committee also viewed that the export product and import product are the same. In view of above, the Committee was unable to finalise the norms and constrained to reject the case. RLA may take suitable consequential action accordingly.

(4) Case No.50 M/s T.W. Exports Pvt. Ltd., New Delhi NC 03/AM-13, dt.26.04.2012 File No.01/84/162/974/AM-08/DES-V Ratification of input output norms against Advance Authorisation No.0510210168 dated 08.10.2007. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to call the applicant firm for personal hearing before NC alongwith sample, complete justification and technical person to explain the case. The case stands for re-listing on 24.05.2012.

(5) Case No.51 M/s Hitex Healthcare, Una, Himachal Pradesh NC 03/AM-13, dt.26.04.2012 File No.01/84/162/371/AM-12/DES-V Ratification of input output norms in respect of Advance Authorisation No.2210012476 dated 31.01.2012. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Mr. Ashish Kumar Mittal, Chartered Accountant, present before the NC on behalf of the firm and presented the sample and explained the details of the export product before the Committee. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case as detailed below:- S.No. Export Product Export Quantity Import item Quantity allowed 1. The GSM of fabric used in the garment would match the GSM of fabric imported under the 3,00,000 Nos. Non-woven fabric (SMS), 25GSM to 70 GSM 36,540 Kgs (@ 116 grams weight per piece + 5% wastage)

PRO version licence. The GSM should match in both import and export. The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

(6) Case No.52 M/s K.E. Technical Textiles Pvt. Ltd. NC 03/AM-13, dt. 26.04.2012 File No.01/84/50/355/AM-12/DES-V Ratification of input output norms in respect of Advance Authorisation No.0210134925 dated 07.12.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details of the case. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to re-fix the Advance Authorization issued in this case by allowing 8% wastage from 6% wastage as detailed below:- S.No. Export Product Export Quantity Import item Quantity allowed 1. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details of the case. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to refer to DC (MSME) for their examination and comments. It was decided to defer the case for re-listing on 24.05.2012.

(9) Case No.55 M/s Gaurav International, New Delhi File No.01/84/50/064/AM-09/DES-V Ratification of input output norms against Advance Authorization No.0510217510 dated 07.03.2008. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. It was decided to defer the case for re-listing on 24.05.2012

Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. (13) Case No.59 M/s Richa & Co., New Delhi Part File No.01/84/162/438/AM-12/DES-V Ratification of input output norms against Advance Authorization No.0510307705 dated 14.11.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to refer to DC (MSME) for their examination and comments. It was decided to defer the case for re-listing on 24.05.2012

(14) Case No.60 M/s Richa & Co. New Delhi Part File No.01/84/50/111/AM-07/DES-V Re-fixation of input output norms against Advance Authorization No.0510183620 dated 29.05.2006.. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case has already been finalised by NC in its meeting No.02/AM-13, held on 19.04.2012. The Committee, therefore, decided to withdraw this case from the agenda.

(15) Case No.61 M/s Techno Flex Industries, Mysore File No.01/84/50/228/AM-12/DES-V Ratification of input output norms against Advance Authorization No.0710082683 dated 22.09.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to refer to DIPP for their examination, issue of deficiency letter to applicant firm and comments. It was decided to defer the case for re-listing on 24.05.2012.

(16) Case No.62 Ref. received from Jt. DGFT, Kolkata, M/s Bhadresh Trading Corporation Ltd. Mumbai File No.01/84/162/717/AM-09/DES-V Fixation of SION for Raw Cotton carded or combed. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to seek the comments/views of technical members of the Norms Committee-V. On receipt of the comments/views of the technical members of the NC, a final view will be taken in the matter. It was decided to defer the case for re-listing on 17.05.2012.

Outside agenda cases

(17) Case No.1 M/s Richa Global Exports Pvt. Ltd., New Delhi File No.01/84/162/587/AM-08/DES-V Re-fixation of input output norms against Advance Authorization No.0510207010 dated 31.07.2007. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Mr. Kamal Sharma, Manager (Import), present before the NC on behalf of the firm. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to re-fix the Advance Authorization issued in this case as detailed below:-
