The Meeting No. 06/AM-11 for the licensing year 2010-11 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 06.05.2010 in Room No. 108 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. In view of this, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to advise R.A to work out the Qty. of input as per Policy Circular No. 34/(RE-07)/2004-2009 dated 24th March, 2008 in this case. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that reply called for from the firm is still awaited. It was therefore decided to defer the case for re-listing on 03.06.2010.

Case No. 54 M/s Jiwanram Sheoduttarai Industries Pvt. Ltd., Kolkata F.NO.1/84/162/392/AM10 -DES-V Re-fixation of input output norms in respect of Advance Authorization No. 0210129865 dt. 31.07.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the sample, drawing submitted by the firm in this case. It was observed that sample received did not match with the export item i.e ‘Trousers with hang pocket’ as mentioned in the advance authorization in question in this case. Accordingly, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to disallow the item of import at S.No. 1 to 3. The item of import at S.No. 4 to 10 may be allowed on net to net basis with 1% wastage.

Case No. 55 M/s Techno Flex Industries, Mysore. F.NO.1/84/50/239/AM10 -DES-V Re-fixation of input output norms in respect of Advance Authorization No. 0710069324 dt. 08.01.2010. Decision: The Committee considered the case as per agenda and went through the information/details submitted by the firm in this case. The Committee after detailed deliberation in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case as per recommendations of DIPP as detailed below: -

(i) The item of import at S.No.1 i.e Cellulose Insole Board sheets (size 1X1.50 M, thickness-1.5 MM to 1.75 MM) may be allowed 20043 Sq mtrs.

PRO version (ii) The item of import at S.No.2 i.e Shank Board (size 1.06 X1.58 M, thickness-1.80 MM) may be allowed 9770 Sq mtrs. (iii) In the description of export product, the following should be added, “containing Cellulose Insole Board sheets minimum – 19088.5 Sq mtrs. and Shank board minimum – 9304 Sq mtrs.

The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

Case No. 56 M/s A.S Fashions Pvt., Ltd., New Delhi F.NO.1/84/50/192/AM10 -DES-V Re-fixation of input output norms in respect of Advance Authorization No. 051253929 dt. 04.12.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. Dhiraj Jha, Director, who appeared for personal hearing alongwith one other representative of the firm in this case. They explained the case alongwith sample, paper pattern, measurement and calculation sheet pertaining to the export items in question. The Committee went through these details and observed that consumption of fabric is on higher side due to the fact that both the export items i.e Ladies Top and Ladies Dress are brass beaded in this case. The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting felt that quantitative requirement of fabric as claimed by the firm i.e @ 1.90 Sq mtrs/Pc against export item No.1 (Style No. M220) and @ 2.44 Sq mtrs/Pc against export item No.2 (Style No. M221) respectively is justified. Hence, the Committee decided to ratify the Advance Authorization issued in this case as applied by the firm.

The GSM should match in both import and export.

Case No. 57 M/s Ganga Acrowool Ltd., Ludhiana F.NO.1/84/162/640/AM09 -DES-V Re-fixation of input output norms in respect of Advance Authorization No. 3010056431 dt. 29.05.2008.

PRO version Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was cleared by NC in its meeting held on 18.03.2010 by allowing all range of deneirage including 4-6 denier of Acrylic Yarn in all the advance authorizations mentioned therein. Therefore, R.A may be advised to take all range of denier including 4-6 D in these cases as applied by the firm. As regards another issue i.e Acrylic Tops and Acrylic Fibre, the firm may be advised to submit copy of complete set of advance authorization application to go through the details separately for reconsideration of the matter. They may also be advised not to mix up different issues with this case.

Case No. 58 M/s Ganga Acrowool Ltd., Ludhiana F.NO.1/84/50/242/AM09 -DES-V Re-fixation of input output norms in respect of Advance Authorization No. 3010058852 dt. 20.11.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was cleared by NC in its meeting held on 18.03.2010 by allowing all range of deneirage including 4-6 denier of Acrylic Yarn in all the advance authorizations mentioned therein. Therefore, R.A may be advised to take all range of denier including 4-6 D in these cases as applied by the firm. Case No. 59 M/s Roy International, Kochi F.NO.1/84/50/760/AM06 -DES-V Amendment in Advance Authorization No. 1010024556 dt. 09.10.2006. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in this case the firm had applied for import of Undyed Polyester Yarn and export of Dyed Polyester Yarn indicating specific Qty. in different colours. Now, they are indicating the description of export item ‘ Polyester Yarn Dyed in varying colours’ instead of specifying

PRO version colour-wise Qty. in the future advance authorizations. This fact has not been brought to the notice of NC in its meeting held on 04.03.2010 during personal hearing of the firm. In view of this, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to allow the amendment in the description of export item to read as “Polyester Dyed Yarn” in various colours and ratify the norms with 1% wastage taking lenient view in this case. R.A may issue EODC accordingly.

Case No. 60 M/s Roy International, Kochi F.NO.1/84/50/760/AM06 -DES-V Amendment in Advance Authorization No. 1010024636 dt. 18.10.2006. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in this case the firm had applied for import of Undyed Polyester Yarn and export of Dyed Polyester Yarn indicating specific Qty. in different colours. Now, they are indicating the description of export item ‘ Polyester Yarn Dyed in varying colours’ instead of specifying colour-wise Qty. in the future advance authorizations. This fact has not been brought to the notice of NC in its meeting held on 04.03.2010 during personal hearing of the firm. In view of this, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to allow the amendment in the description of export item to read as “Polyester Dyed Yarn” in various colours and ratify the norms with 1% wastage taking lenient view in this case. R.A may issue EODC accordingly.

Outside agenda cases

Case No. 1 M/s Indo British Garments Pvt. Ltd., Faridabad F.NO.1/84/50/390/AM08 -DES-V Ratification of input output norms in respect of Advance Authorization No. 0510215299 dated 22.01.2008. Decision: The Committee considered the case as per agenda alongwith other relevant papers and perused the report of team of officers of the Norms Committee, who had visited the unit of the applicant firm to study the manufacturing process. The report of NC team has been taken on record. It was also observed that export item in this case is actually “Double Jackets (with removable

PRO version vest)” and hood. The removable vests are removed during daytime and re-attached at nighttime depending upon the convenience and temperature. The Committee after deliberations felt that the fabric consumption @ 6.43 Sq mtrs./Pc is justified in this case. Accordingly, the Committee decided to ratify the input output norms against the advance authorization issued in this case as detailed below: - Export item Export Qty. Import item Qty. allowed per piece of export item Men’s Jacket made of P/d Poly Twill fabric (100% Polyester fabric with or without PU coating), GSM- 180+/-10% 5882 Pcs P/d Poly Twill (100% Polyester fabric with or without PU coating), GSM- 180+/-10% @ 6.43 Sq mtrs/Pc For future authorization, the firm may be advised to amend the description of export item to read as “Double Jackets (with removable vest)”. The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

Case No. 2 M/s Loyal Textile Mills Ltd., Kovilpatti NC38/10 dt. 17.12.2009 F.NO.1/84/50/09/AM10 -DES-V Re-fixation of input output norms in respect of Advance Authorization No. (i) 3510026302 dt. 08.04.2009 and (ii) 3510022042 dt. 25.10.2007. Decision: The Committee considered the case as per agenda alongwith other relevant papers and perused the report of team of officers of the Norms Committee, who had visited the unit of the applicant firm to study the manufacturing process. The recommendations of NC team are as detailed below:-
