Minutes of NC-V meeting held on 08.11.2012 The meeting No.31/AM-13 for the licensing year 2012-13 to consider the cases under Duty Exemption Schemes (Chapter- 4) held on 08.11.2012 in Room No.11 of DGFT under the Chairmanship of Shri K.C. Rout, Addl. DGFT. The following officers were present:-

At the outset, the Minutes of NC-V Meeting No.30/AM-13, dated 01.11.2012 were taken for ratification. As there were no amendments to the same, the above referred minutes of 01.11.2012 were adopted for implementation by the Committee without any amendment. Mr. Manivanan presented the samples and explained the details of the case before the Committee. The representative of the applicant firm explained before the Committee that when the technical team of DGFT visited their unit in February, 2010, the regular production was based on earlier quality specifications, only and trial run was going on for the process for higher specification which required more chemicals. The representative of the applicant firm also informed that while applying for higher quantity for new stringent specifications, they were under impression that by the time, visit of Norms Committee team takes place, they may be in a position to demonstrate new process with higher specifications and requirements of more chemicals but they could not do so. Therefore, the Committee decided the norms, based on running process which was for earlier specifications and lower requirement of chemicals. Technical members of the Committee informed that during the spot study, the technical team physically witnessed the process and got the processing of the fabric carried out in their presence, noting down the unprocessed weight, GSM etc. of the grey and finished fabric, consumption of finishing liquor, thereby pro-rata consumption of various chemicals in such finishing liquor formulation per kg of finished fabric. The Committee corroborated these consumption data with the department’s log book where past production data of processing of various lots are maintained together with consumption of finishing liquor. In its third check, the technical members tallied these consumption data with the dyes and chemicals issued from dyes and chemicals stores for the respective lots. With these three checkpoints, the data were analysed and finally the technical members reached a logical conclusion about the consumption of various chemicals per Kg. of export product. Thus, Committee does not take into cognizance only the data maintained by the unit but also physically tests the requirement by getting the process carried out in its presence. The Technical members further stated that if decision has to be taken on the basis of data certified by CA and supplied by the applicant firm, the statement and data submitted are amply clear and there is nothing for the technical members to comment upon technicalities of such data. The decision can be taken by O/o DGFT itself on the basis of data supplied by the applicant. However, Committee feels that being expensive chemicals and involvement of revenue on account of saved import duty, it would be appropriate if the foolproof method of deciding the consumption by a spot study of the team at the production facilities of the unit, is carried out.
PRO version As regards to the request of the applicant firm to make the public notice No.88/RE:2010)/2010/2009-2014 dated 27.12.2011 regarding enhancement in value cap, effective from retrospective date, committee felt that their request deserves to be considered from the date, the request for enhancement in value cap has been submitted or the early date of authorization i.e. 25.10.2007, for which committee visited their unit in February, 2010. A policy decision is required to be taken at the O/o DGFT in this matter, looking to the possibility of cases that may come for similar benefit.
