Minutes of NC-V meeting held on 03.01.2013

        The meeting No.39/AM-13 for the licensing year 2012-13 to consider the cases under Duty Exemption Schemes (Chapter-

At the outset, the Minutes of NC-V Meetings No.36/AM-13, dated 13.12.2012 and 37/AM-13, dated 20.12.2012 was taken for ratification. As there were no amendments to the same, the above referred minutes of 13.12.2012 and 20.12.2012 were adopted for implementation by the Committee without any amendment. The agenda for meeting No.39/AM-13 dated 03.01.2013 was taken up for discussion and the decision taken in respect of each case is enumerated below:-

Width of the fabric in inches or meters has also not been given by the applicant firm. In view of above, the Committee was unable to finalise the norms and constrained to reject the case. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the item of export is basically ‘Booklets’ and classification of export product under chapter 54 of ITC (HS) Code is not tenable. The export product falls under chapter 49 of ITC (HS) Code. The applicant firm has already applied for ratification of Advance Authorization No.0310715611 dated 23.11.2012 indicating “Booklet containing fabric samples” and mentioned ITC (HS) code as 49011020 with the same import item. Therefore, after deliberation the Committee has decided to transfer this case to NC-IV for a decision.

DGFT, Kolkata File No.01/84/162/505/AM-13/DES-V Clarification in respect of 100% Natural Silk Fabrics covered by SION J-124 (Textile Group) Decision: The Committee considered the case as per agenda alongwith other relevant papers and examined the request of Office of the Jt. DGFT, Kolkata to clarify whether the ‘100% Natural Silk Fabrics’ as described in SION J-124 and ‘Natural Silk Fabrics’ as described by the exporters are one and the same. The Committee after deliberations with the technical members of the Committee clarified that both ‘100% Natural Silk Fabrics’ and ‘Natural Silk Fabrics’ may be treated as similar.

(32) Case No.6 M/s Loyal Textiles Mills Ltd., Kovilpatti File No.01/84/50/189/AM-11/DES-V Ratification of Input Output Norms in respect of Advance Authorization No.3510030915 dated 14.07.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and re-visited the issue of higher wastage norms. The Technical Members of the Committee felt that the ad-hoc norms for these products were earlier fixed based on factory visit by the technical members of the Norms Committee on 8th/9th February, 2010. During the visit, the technical members of the Committee saw the entire process and examined the requirement of raw material at each stage.

PRO version Secondly, the industry data from 3 other firms were taken on record while fixing the wastage norms. The norms were fixed in NC meeting held on 31.03.2011.

Thereafter, M/s Loyal Textiles Mills Ltd., Kovilpatti has been representing to enhance the wastage norms whereas NC has not received any representation from other firms so far. Therefore, the Technical Members of the Committee felt that since the ad-hoc norms were fixed based on industry data of three other firms, enhancing the wastage norms on the basis of representation of one firm will not be a fair decision. Any further enhancement of wastage norms only for this firm will only be possible on the actual requirement to be certified by a factory visit. If factory visit is not permissible as a policy, then Technical members expressed their inability to be a party to any decision for further enhancement of wastage norms. Accordingly, the Committee could not agree with the request of the applicant firm.
