Case No M-127

NC No.20/14 Dated 14.8.2013 (held on 16.8.2013) M/ s Silver Oak Labs (P) Ltd, F.No. 01/83/50/221/AM08/DES-IV RLA F.No. 05/24//040/00066/AM08/ License No. 0510203034 dated 27.04.2007

Committee re-considered the case as per Agenda and noted that Technical Authority, DIPP, has re-examined the case based on the letter dated June 18, 2013, received from the firm, wherein the firm have submitted their reply enclosing hard copy of application, License Copy, a declaration for export & import items, FDA Certificate, A.R.E. – 1, Export Invoice, Shipping Bill, Chartered Engineer Certificate, raw material specification.

Committee also noted that TA, DIPP, while examining the application and shipping bills, observed that the unit of export item in numbers whereas in the shipping bills /Export invoice/ARE-1 (duly authenticated by central excise), unit is given in grams. The firm has also submitted a Chartered Engineer certificate certifying the weight of Export Product. After obtaining all corroborative evidences from the firm, TA, DIPP, observed that the weight of one number of export item is 25.72 grams.

The firm has also submitted a copy of approved formula from Drug Authority, declaration regarding import and export items and they have claimed 0.50% wastage on bulk raw materials which, in the opinion of TA, DIPP, is reasonable. However component is allowed on net to net basis.

Taking all the facts and circumstances into account, Committee decided to re-consider and approve norms, as per written recommendation of Technical Authority, Department of Industrial Policy & Promotion, vide their U.O. No. 7/100/2013-TSW dated 12.08.2013, as under:-

Committee re-considered the case as per Agenda and noted that the case has been re-examine vide letter dated June 21, 2013, received from firm, wherein, they have submitted their reply enclosing hard copy of application, License Copy, a declaration for export & import items, FDA Certificate, A.R.E. – 1, Export Invoice, Shipping Bill, Chartered Engineer Certificate, raw material specification.

Committee further noted that while examining the application and shipping bills, Technical Authority, Department of Industrial Policy & Promotion, observed that the unit of export item in numbers, whereas in shipping bills /Export invoice/ARE-1 (duly authenticated by central excise), unit is given in grams. The firm has also submitted a Chartered Engineer certificate certifying the weight of Export Products.
