The Committee considered the case as per agenda and observed that the case was rejected in its
M. No.19.06 held on 09.08.2005 as the firm has indicated the export and import product as the same
without any difference. In the meantime firm has exported the product and argued that the export
product is different from import product. The firm argued that the import item is uncrushed Lumps of
Silicon Metal. These were imported and crushed into a final particle and the case is cleared subject to
firm producing Central Excise documents to prove the consumption and also the complete set of
Shipping Bills and Bill of Entry to the RA to prove that import and export products were different. RA is
instructed to redeem the case only after the compliance of above two documents.
