Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm have not furnished the past export performance for the preceding three years as envisaged in the Foreign Trade Policy provisions. In view of this Committee decided to reject the case. It was also decided to ask R.A as to why this case has been referred to Norms Committee in view of the above position.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and perused the details submitted by the firm and technical members of the Committee observed that Qty. already allowed by NC in its meeting 27.12.2007 on the basis of recommendations of DC (MSME) is adequate hence, no enhancement is justified thereon. In view of this Committee decided to maintain status quo in this case.

firm quoted the rate in square meter and consumption on EVA is computed as per square meter, which is 40 Gram
per square meter and the specification of fabric is Cotton fabric. Accordingly, Committee after detailed deliberations
in consultation with representatives of technical authorities present in the meeting decided to ratify the advance
authorization issued in this case on net to net basis with accountability clause. The description of export item may be
amended to read as Fusible Interlining material coated with EVA containing 40 Gram per Square meter.

PRO version Request for regularizations of audit objection in respect of transferable DFRC Nos. 0210087031 dated 10.03.2006, 0210087033 dated 10.03.2006 under SION, J-274 and J-148, Policy relaxation of FTP in terms of Para 2.5 for relaxation of General Note No. 14 of Textile Product. Decision: The Committee considered the case as per agenda and observed that condition No. 14 mentioned in General Note of Textile Product Group i.e ‘Licences issued as per the norms at S.Nos. J-270 to J-296 shall be with Actual User condition and materials imported there against even after the fulfillment of the stipulated export obligation shall not be transferred and the same shall be utilized only for further export production’, requires review. It was felt that the said condition was imposed when imported fabric had a premium in the domestic market. Now, with the modernization of Textile industry and upgradation of technology in the processing of fabric, excellent fabric is produced within the country. Thus, imported fabric does not command any premium in the domestic market. Therefore, the Committee felt that the condition of ‘Actual User’ in the General Note No. 14 of Textile product Group may be deleted by relaxing the Policy for the DFRC case. Further, the Committee would take the views of AEPC before taking final decision on deletion of the condition of ‘Actual User’ in the General Note No. 14 of Textile product Group. The Committee decided to refer the case to PRC for relaxation of Policy to the General Note No. 14 of Textile product for DFRC in question.
