Minutes of NC-V meeting held on 17.05.2012

        The meeting No.06/AM-13 for the licensing year 2012-13 to consider the cases under Duty Exemption Schemes (Chapter-
  1. held on 17.05.2012 in Room No.108 of DGFT under the Chairmanship of Shri A.K. Singh, Jt. DGFT. The following officers were present:-

The agenda for meeting No.06/AM-13 dated 17.05.2012 was taken up for discussion and the decision taken in respect of each case is enumerated below:-

PRO version Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case as detailed below:- S.No. Export Product Export Quantity Import item Quantity allowed 1. (2) Case No.93 M/s Saivana Exports Pvt. Ltd., New Delhi File No.01/84/162/025/AM-13/DES-V Fixation of input output norms against Annual Advance Authorisation No. 0510249783 dated 23.09.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm has not submitted drawing/design, CAD/CAM for any of the export product. In view of above, the Committee was unable to finalise the norms and constrained to reject the case. RLA may take suitable consequential action accordingly. (3) Case No.94 M/s Chinar Forge Limited File No.01/84/50/201/AM-11/DES-V Ratification of ad-hoc norms in respect of Advance Authorisation No.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that applicant firm has not submitted additional information in support of their proposal. Without requisite information, the Committee was unable to compute the requirement of inputs asked for and decided to maintain status quo in this case.

PRO version File No.01/84/162/52/AM-13/DES-V Request to facilitate the issue of DFIA Authorization under Textiles SION J-51 for export of Dyed/Printed Embroidered 100% Natural Silk Fabrics against the import of 100% Natural Silk Fabrics for the ratio of 1 Sq. Meter:1.01 Sq. Meter. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in the shipping bill, the description of export product given as “100% Pinted Natural Silk Fabrics (Width: 44” – 54 GSM)” whereas in SION J-51, the description of export product given as “Grey/Dyed/Printed Fabrics with Embroidery”.

        It is observed that the description of export product given in SION J-51 does not match with one to one description of

export product given in shipping bill.

If the export product is not embroidered, the Committee agreed with the decision of the RA that the export product does not covered under SION J-51.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. PRO version File No.01/84/50/005/AM-10/DES-V Amendment in export item under No Norms against Advance Authorisation No. 0410103574 dated 02.04.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that for the new export product, applicant firm has not given the style number, drawing/design, CAD/CAM, justification of the export item. Without requisite information, the Committee was unable to compute the requirement of fabric and decided to maintain status quo in this case.

Silks Fabric, Bangalore File No.01/84/162/52/AM-13/DES-V Request to facilitate the issue of DFIA Authorization under Textiles SION J-51 for export of Dyed/Printed Embroidered 100% Natural Silk Fabrics against the import of 100% Natural Silk Fabrics for the ratio of 1 Sq. Meter:1.01 Sq. Meter – Clarification Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that in the shipping bill, the description of export product given as “100% Printed Natural Silk Fabrics (Width: 44” – 54 GSM)” whereas in SION J-51, the description of export product given as “Grey/Dyed/Printed Fabrics with Embroidery”.

        It is observed that the description of export product given in SION J-51 does not match with one to one description of

(8) Case No.99 M/s Kushi Enterprises, Bangalore File No.01/84/162/51/AM-13/DES-V Request to facilitate the issue of DFIA Authorization under Textiles SION J-51 for export of Dyed/Printed Embroidered 100% Natural Silk Fabrics against the import of 100% Natural Silk Fabrics for the ratio of 1 Sq. Meter:1.01 Sq. Meter.

In the present case, shipping bill No.KE/002/11-12 dated 14.3.2012 relating to Invoice No.KE/002/11-12, dated 14.3.2012 relating to description of export product does not mention whether it is embroidered or not. If the export product is not embroidered, the Committee agreed with the decision of the RA that the export product does not covered under SION J-51.

Case No.100

M/s Advance Syntex Pvt. Ltd., Vadodara File No.01/84/50/286/AM-12/DES-V Ratification of Advance Authorisation No.3410032103 dated 04.11.2011 under para 4.7 of HBP. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Mr. Babu Exhumavil, present before the NC on behalf of the firm. Mr. Babu presented the samples of the export product and explained the details of the export product before the Committee. After seeing the samples, the Committee does not understand whether the export product is powder or yarn. Thereafter, Committee after deliberations in consultation with representatives of technical authorities present in the meeting advised the applicant firm to approach the Customs Classification Committee to get the classification of the export product whether it is yarn or powder as well as ITC (HS) Code under which the export product is covered. After classification of the export product, the applicant firm may approach the concerned Norms Committee for the fixation of norms for export product. Accordingly, Committee has decided to defer the case for re-listing on 28.06.2012.

Case No.101

Ref. received from the PC-IV-B, M/s Aditya Birla Nuvo Ltd., Kolkata NC 06/AM-13, dt. 17.05.2012 File No.01/84/162/376/AM-12/DES-V Clarification sought as to whether “Blankets/Blazer/Cloth/ Vellour/Overcoating/Jacketing Cloth made of synthetic wastage/woollen waste/Woollen rags/Synthetic rags/Scoured Wool” are covered under DEPB

PRO version entry Sl. No.20 of the Product Group “Textiles”. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the case was listed for personal hearing on 17.05.2012. However, no representative from applicant firm appeared for personal hearing. In view of this, Committee was decided to give another opportunity to applicant firm to present their case before NC and re-list the case for personal hearing on 14.06.2012.

M/s T.H.E. Makers Pvt. Ltd., New Delhi File No.01/85/50/187/AM-04/DES-V Ratification of input output norms against Advance Authorization No.0510093295 dated 13.06.2003. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Ms. Anjali J. Manish, Advocate, present before the NC on behalf of the firm. In the meeting, Ms. Anjali has informed that in the application, the applicant firm has, inadvertently, indicated the wrong description of export product as “100% Polyester performance fleece contrast top zip mock T Shirt – Half Sleeve” whereas actually the export item is T- Shirt – full sleeve which was indicated in the shipping bills. There are 10 shipping bills. Ms. Anjali requested the Committee to ignore the application and approve the proposal as per shipping bills. Ms. Anjali requested the Committee to approve their case as per SION and customs duty, if any, will be paid by the applicant firm. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Ms. Neelam Negi, present before the NC on behalf of the firm. Ms. Negi presented the sample before the Committee and explained that the export product is actually Kaftan used as swimware. The Committee observed that the sample is good to be used for swimming. Mr. Bhagwant Singh presented the sample and explained the details of the export product before the Committee. There is no change in the other decision of NC meeting held on 22.01.2004. RLA may take suitable consequential action accordingly. (15)

Case No.106

Ref. received from Jt. DGFT, Kolkata, M/s Bhadresh Trading Corporation Ltd. Mumbai File No.01/84/162/717/AM-09/DES-V Fixation of SION for Raw Cotton carded or combed. Decision: The Committee considered the case as per agenda alongwith other relevant papers and viewed that the insecticides, pesticides etc. are required for cotton farming. The Committee felt that quantity allowed in SIONs is justified and no change is required in the SIONs, J-373 w.r.t. Biocides/Fungicides/Herbicides/Insecticides. The Committee members felt that farmers are not exporters and if actual user condition is imposed, merchants could not be able to import this item. However, since imposing actual user condition is a policy decision, it is open to Government to impose actual user condition, though the Committee does not recommend this. (16)

M/s Niyaz Apparels, Chennai File No.01/84/162/498/AM-08/DES-V Re-fixation of ad-hoc norms against Advance Authorization No.0410031790 dated 01.10.2002. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to call the applicant firm for personal hearing before NC alongwith sample showing the use of 0.913 sq. meter/pcs and 2.25 sq. meter/pcs on both the garments, drawing/design, CAD/CAM, complete justification and technical person to explain the case. The case stands for re-listing on 14.06.2012.

Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to rectify the errors and import quantity should be read as 5592.8 Kgs. in place of 5592.8 Sq. meters.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to maintain status quo in this case, taking in cue from SION, J-195 in terms of Policy Circular No.34/RE-07/2004- 2009, dated 24.03.2008.

Therefore, the Committee has suggested to the representative (s) of applicant firm present in the meeting to reduce the number of export product and it should be only 6 export product. The representatives of the applicant firm present in the meeting informed that they are withdrawing their request and they will submit a revised application for consideration of the Norms Committee. The case is deferred for re-listing on 14.06.2012.
