Minutes of NC-V Meeting held on 25.08.2011

The Meeting No. 21/AM-12 for the licensing year 2011-12 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 25.08.2011 in Room No.11 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. DGFT. The following officers were present: -

At the outset the Minutes of NC-V Meeting No.20/AM12 dated 18.08.2011were ratified. Thereafter agenda for Meeting No. 21/AM12 dated 25.08.2011 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the description of export item mentioned does not indicate as to whether it is completer shoe or part thereof. Further, export Qty. is mentioned in ‘pairs’ and no details of all the import items asked for have been mentioned in the export item (size-wise) column alongwith justification of quantitative requirement of each items. They nave neither given CAD, CAM, drawing, design, laymarker, calculation sheet etc alongwith justification thereof in this case. In view of the above facts Committee was unable to compute the requirement of inputs. Therefore, Committee was constrained to reject the case.

           RA may take suitable consequential action accordingly.

M/s Home Fabrics, Bangalore NC No.21/AM12 F.No.01/84/162/132/AM12/DES-V Dated 25.08.2011 Ratification of input output norms against advance authorisation No. 0710079328 dated 23.05.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. Accordingly, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case as detailed below:- S. Case No.123

M/s East End Silks Pvt. Ltd., Kolkata NC No.21/AM12 F.No.01/84/50/320/AM11/DES-V Dated 25.08.2011 Ratification of input output norms against advance authorisation No. 0210153529 dated 13.01.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. It was observed that in SION, J-123, from Raw Silk (Gummed & untwisted) to fabric 39% wastage is allowed. In the instant case, it is not clear from the details submitted the manufacturing condition of Mulberry silk waste and how total wastage is arrived at 43.45%. In view of the above, Committee decided to call the applicant firm for personal hearing before NC alongwith complete justification and technical person to explain the whole process justifying the wastage claimed therein. The case stands for re-listing on 22.09.2011.

Case No.124

M/s JCT Ltd., Phagwara NC No.21/AM12 F.No.01/84/50/34/AM12/DES-V Dated 25.08.2011 Ratification of input output norms against advance authorisation No. 3010074039 dated 31.03.2011. Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting decided to ratify the advance authorization issued in this case as per written comments of DC (MSME) conveyed vide their U.O NO. 37(5)/23/2011-12/Hosy. dated 25.08.2011 as detailed below: - S. No Export item Import item Qty. allowed. 1 Textile fabric (cotton) with AFLAMMIT KWB fire retardant finish. (177154 mtrs. width 148 to AFLAMMIT KWB fire /flame retardant based on dailkylated phosphonopropionic acid 25000 Kgs.

Case No.125

Ref. from Jt. DGFT, Mumbai in respect of M/s Creative Textiles Pvt. Ltd., Mumbai NC No.21/AM12 F.No.01/84/162/84/AM12/DES-V Dated 25.08.2011 Clarification regarding technical aspect of export item against the advance authorisation No. 0310534110 dated 18.08.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. The Committee decided to seek clarification of applicant firm on the question raised by the Customs authority in this case as informed by R.A, Mumbai. The case stands for re-listing on 22.09.2011.

Case No.126

M/s M.K. Fashions, Mumbai NC No.21/AM12 F.No.01/84/162/122/AM12/DES-V Dated 25.08.2011 Re-fixation of input output norms against advance authorisation No. 0310175422 dated 31.12.2002. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to call the applicant firm for personal hearing before NC alongwith complete justification and technical person to explain the case. The case stands for re-listing on 22.09.2011.

Case No.127

M/s Pacific Leather, Kanpur NC No.21/AM12 F.No.01/84/50/32/AM12/DES-V Dated 25.08.2011 Ratification of input output norms against advance authorisation No. 06100213971 dated 28.03.2011.

PRO version Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. T.D. Chopra, an authorised representative of the firm, who appeared for personal hearing before NC. He explained the case alongwith sample but technical members of the Committee pointed out that export Qty. asked for in this case is in Pair (not in Kg.) and import Qty. asked for is in Kg, hence, it is not possible to account for the Qty. of inputs in the export product in Kg. It was also pointed out the Committee that there is one similar item (A/A No. 0610017463 dated 18.03.2010) issued to the applicant firm. In view of the above, Committee felt that before taking final decision in the matter, technical members of NC may visit the unit of the applicant firm for spot study. The case stands for re-listing on 22.09.2011.

Case No.128

Ref. from MEPZ Special Economic Zone, TamilNadu in respect of M/s Intimate Fashions (India) Pvt. Ltd. NC No.21/AM12 F.No.01/84/162/128/AM12/DES-V Dated 25.08.2011 Fixation of norms for Lace Jacquardtronic allover stretch fabric used in the product ‘Ladies Knitted Brassieres. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to refer to DC (MSME) for their examination and comments. It was decided to defer the case for re-listing on 22.09.2011.
