Minutes of NC-V Meeting held on 29.09.2011

The Meeting No. 26/AM-12 for the licensing year 2011-12 to consider the cases under Duty Exemption Schemes (Chapter-4) was held on 29.09.2011 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC-V Meeting No.25/AM12 dated 22.09.2011 were ratified. Thereafter agenda for Meeting No. 26/AM12 dated 29.09.2011 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

The Committee considered the case as per agenda alongwith other relevant papers and decided to call the applicant firm for personal hearing before NC alongwith sample, complete justification and technical person to explain the case. The case stands for re-listing on 27.10.2011.

Case No. 174

M/s Kanak Exim, Chennai NC No.26/AM12 F.No.01/84/162/130/AM12/DES-V Dated 29.9.2011 Request for clarification as to whether Phenol can be used as Syntan under SION G-7.

The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting and written comments of DIPP vide their note dated 28.9.2011, decided to reject the request of the firm on the ground that although Phenol has some tanning properties but by and large, it is used as raw material for the preparation of aromatic based syntan which is subjected to Sulphonation and Condensation process. Secondly the firm has not given complete justification to include phenol as syntan under SION G-7 & G46 for export of finished leather.

M/s Hunter Douglas India Pvt. Ltd., Mumbai NC No.26/AM12 F.No.01/84/50/44/AM12/DES-V Dated 29.9.2011 Ratification of input output norms in respect of advance authorisation No.0310582418 dated 7.7.2010 under para 4.7 of HBP.

      The Committee considered the case as per agenda alongwith other relevant papers and observed that the case is under examination of DIPP and comments are awaited. It was therefore decided to defer the case for re-listing on 10.11.2011.

Ref. from Jt. DGFT, Mumbai in respect of M/s Creative Textiles Pvt. Ltd., Mumbai NC No.26/AM12 F.No.01/84/162/84/AM12/DES-V Dated 29.9.2011 Clarification regarding technical aspect of export item against the advance authorisation No. 0310534110 dated 18.08.2009. Decision. The Committee considered the case as per agenda alongwith other relevant papers and observed that the case is under examination of DC (MSME) and comments are awaited. It was therefore decided to defer the case for re-listing on 27.10.2011.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Mr. M Ashfaq representative of the firm, who appeared for personal hearing before NC. He explained export items alongwith sample. In view of this, Committee after deliberations in consultation with representatives of technical authorities present in the meeting and decided to fix the ad- hoc norms against the advance authorization as detailed below:-

The Committee considered the case as per agenda alongwith other relevant papers and heard Mr. Gopal Kapur Managing Director of the firm, who appeared for personal hearing before NC. He explained export items alongwith sample. They have stated that there had been some changes in their export order by their buyer mainly divided skirt was changed to girl’s trouser. In view of this, Committee after deliberations in consultation with representatives of technical authorities present in the meeting, decided to fix the ad-hoc norms against the advance authorization as detailed below:-
