Minutes of NC-V meeting held on 29.12.2011

        The meeting No.39/AM-12 for the licensing year 2011-12 to consider the cases under Duty Exemption Schemes (Chapter-

4. held on 29.12.2011 in Room No.11 of DGFT under the Chairmanship of Shri A.K. Singh, Jt. DGFT. The following officers were present:-

M/s Superhouse Ltd., Kanpur Part File No.01/84/50/531/AM-07/DES-V Re-fixation of input output norms against advance authorization No. 0610011781 dated 28.2.2007. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Shri Rashid Ali, Manager (Import & Export) of the firm and seen the sample and shipping bills in personal hearing. It is observed from the sample that PVC leather cloth is used as inner panel in the across inseam. From one application, it is seen that PVC leather cloth is used in indigenous product in 420 GSM in across in KG terms has been mentioned in the shipping bill. The Committee has seen some shipping bills and retain a copy of one shipping bill No.6806511 dated 5.11.2008. For export product total number of items shipped accounted for artificial leather cloth as per design for the sample was 0.35 sq. meter per piece. This work out nearly 150 gms per piece inclusive of

PRO version wastage. Accordingly, the Committee agreed to delete the condition of GSM and seen the accountability of imported item. The applicant firm has been advised that in future in export and import side, besides mentioning of GSM of the imported item, the GSM of the exported item as well as in the application also be mentioned. The firm advised to mention the style number of the exported product in future. Decision: The Committee considered the case as per agenda alongwith other relevant papers. The representative of the firm, Shri Kailash Joshi, Manager, was present in the meeting. The representative of the firm requested for extension of time for personal hearing. The Committee agreed with the request of the applicant firm and decided to re-list the case for 2.2.2012.

During the Norm Committee meeting held on 24.11.2011, it was decided to call the applicant firm for personal hearing before NC meeting alongwith complete relevant

The P.H. letter was sent to the party on 21.12.2011 by Speed post. However, no representative from the firm attended the personal hearing on 29.12.2011. In view of above, Committee was unable to finalise the norms and constrained to reject the case.

Decision: The Committee considered the case as per agenda alongwith other relevant papers. During the Norm Committee meeting held on 24.11.2011, it was decided to ask authorized representative to provide specific information for two stage wastage fabric to patchwork and patchwork to readymade garment and the case was re-listed on 29.12.2011. No reply has been received from the representative of the firm. According, it has been decided to call the applicant firm for personal hearing before NC alongwith requisite information, sample, complete justification and technical person to explain the case. The case stands for re-listing on 2.2.2012.

M/s Fabric Style International, Salem File No.01/84/50/527/AM-05/DES-V Ratification of input output norms against Advance Authorisation No. 3210027023 dated 10.1.2005. Decision: The Committee considered the case as per agenda alongwith other relevant papers. During the Norm Committee meeting held on 24.11.2011, nobody appeared for personal hearing before NC and it was decided to give another date of hearing as a last opportunity to explain their case on 29.12.2011. The P.H. letter was sent to the party on 30.11.2011. However, no representative from the firm attended the personal hearing on 29.12.2011. In view of above, Committee was unable to finalise the norms and constrained to reject the case.
