Minutes of NC-V meeting held on 09.02.2012

        The meeting No.44/AM-12 for the licensing year 2011-12 to consider the cases under Duty Exemption Schemes (Chapter-
  1. held on 09.02.2012 in Room No.108 of DGFT under the Chairmanship of Shri A.K. Singh, Jt. DGFT. The following officers were present:-

Case No.409

M/s Niyaz Apparels, Chennai NC 44/AM-12, dt.9.2.2012 File No.01/84/50/100/AM-02/DES-V Fixation of ad-hoc norms against Annual Advance Authorisation No. 0410026211 dated 9.5.2002. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was considered by the ALC in its meeting No.14/AM-03 held on 25.7.2022 and approved the case allowing the import item No.1 i.e. 100% Nylon full dull Perfecta Plus cotton like rapid dyed fuso W/R fabric @ 1.60 Sq. meter instead of 1.70 Sq. meter as sought by the party and the import item No.2 i.e. 100% Textured Polyester lining mesh @ 0.70 Sq. meter instead of 1.10 Sq. meter as sought by the applicant.

        The Committee observed that in the present case, there is no justification, no CAD/CAM and no requirement of fabric. 

Therefore, the Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided not to change the decision of ALC given in its meeting held on 25.7.2002 and decided to maintain status quo in this case.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. Case No.411

M/s East End Silks Pvt. Ltd., Kolkata File No.01/84/50/319/AM-09/DES-V Ratification of input output norms against Advance Authorisation No. 0210153529 dated 13.01.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the applicant firm was called for personnel hearing on 9.2.2012 before the Committee. However, no representative from applicant firm appeared for the personnel hearing before the Committee. Therefore, Committee has decided to close the case.

M/s Surendra Saddlery, Kanpur File No.01/84/50/109/AM-12/DES-V Ratification of input output norms against Advance Authorisation No. 0610021958 dated 20.05.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the applicant firm was called for personnel hearing on 9.2.2012 before the Committee. However, no representative from applicant firm appeared for the personnel hearing before the Committee. Therefore, Committee has decided to close the case.

Case No.413

M/s B.L. International, New Delhi File No.01/84/162/202/AM-12/DES-V Ratification of input output norms against Advance Authorisation No. 0510296568 dated 14.07.2011. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the applicant firm has not given the measurement of the export product. In absence of the measurement, it is not possible to compute the requirement of fabric for the export product asked for. In view of this, Committee was constrained to reject the case. RLA may take suitable consequential action accordingly.

M/s Orient Craft Pvt. Ltd., New Delhi File No.01/84/162/220/AM-11/DES-V Fixation of ad-hoc norms against Annual Advance Authorisation No. 0510264383 dated 14.05.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to refer to DC (MSME) for their examination and comments. It was decided to defer the case for re-listing on 15.3.2012.

M/s Orient Craft Pvt. Ltd., New Delhi File No.01/84/162/526/AM-11/DES-V Fixation of ad-hoc norms against Annual Advance Authorisation No. 0510264383 dated 14.05.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the applicant firm has submitted CAD and measurement of the export items. The CAD is drawn for different number of stripes for different number of pieces, which has no conformity to each other. It is not possible to ascertain the requirement of inputs per piece of export item from these CADs. The placement of panels does not appears to be in order as each panel length is taken more than the requirement according to the size of export items. The applicant firm has also not provided the sketch/drawing of the export item. In view of above, the Committee was unable to finalise the norms and constrained to reject the case. RLA may take suitable consequential action accordingly.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. In absence of width, it is not possible to compute the requirement of fabric for the export product asked for. In view of this, Committee was constrained to reject the case. RLA may take suitable consequential action accordingly.
