Minutes of NC-V Meeting held on 17.11.2011

The Meeting No. 33/AM-12 for the licensing year 2011-12 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 17.11.2011 in Room No.11 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. DGFT. The following officers were present: -

At the outset the Minutes of NC-V Meeting No.30/AM12 dated 27.10.2011 were ratified. The agenda for Meeting No. 33/AM12 dated 17.11.2011 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Decision : The Committee considered the case as per agenda alongwith other relevant papers and observed that from the applicant is asking for 100% wastage of the export item without any justification for wastage. In view of the above facts Committee was unable to compute the requirement of inputs and constrained to reject the case. RA may take suitable consequential action accordingly.

Decision : The Committee considered the case as per agenda alongwith other relevant papers and heard Mr. Manohar Chand Chauhan (representative of the firm), who appeared for personal hearing before NC. He explained the case alongwith sample but technical members of the Committee pointed out higher wastage and asked for some additional information like CAD, CAM, size wise requirement etc., from the applicant firm. In view of the above, Committee decided to defer the case. The case stands for re-listing on 15.12.2011.

Decision : The Committee considered the case as per agenda along with other relevant papers and observed that since the applicant has sought further time for Personal Hearing, it was decided to defer the case for re-listing on 15.12.2011.

M/s. Surendra Saddlery, Kanpur. F.No.01/84/50/109/AM-12 No.0610021958 dated 20.5.2011. Decision : The Committee considered the case as per agenda along with other relevant papers and noted that since letter issued to the applicant firm for personal hearing has returned undelivered, R.A., Kanpur may be asked to inform the firm accordingly and defer the case for re-listing on 15.12.2011.

Decision : The Committee considered the case as per agenda alongwith other relevant papers and heard Mr. Rakesh Mishra (CEO) representative of the firm, who appeared for personal hearing before NC. M/s. Kabadi Shankarsa & Sons, Bangalore. F.No.01/84/50/136/AM-12 No.0710077835 dated 4.3.2011. Decision : The Committee considered the case as per agenda alongwith other relevant papers and observed that this case has already been decided by NC in its meeting held on 01.09.2011. Now, firm have not submitted any valid justification in support of their request to reconsider the case. Hence, Committee was not able to reconsider the same and constrained to maintain status quo in this case.
Firm may be informed accordingly.
