The gross weight mentioned in the shipping bill indicates the gross weight of packed export product. Normally, the net weight indicated in the shipping bill is the actual weight of export product; hence, it is the weight without taking into account the wastage. The Committee also opined that in such matter no reference should be made to Norms Committee, as there is not any technical

M/s Universal Weavers Pvt. Ltd., Faridabad NC No.34/AM11 F.No.01/84/50/223/AM07/DES-V Dated 18.11.2010 Ratification of input output norms against advance authorization No.0510188196 dated 3.8.2006 Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. Anil Kant, Director and Smt. Prerna of the firm, who appeared for personal hearing before NC alongwith sample and process flow chart pertaining to this case. They explained manufacturing process of their export item safety helmet for personal protection. They also informed that total 18, 888 Pcs of helmet have been exported in this case. The GSM of Kevlar fabric is 440. They explained that in the entire process there is a total 12% wastage. The representative also informed that the average weight of one piece helmet is 1.50 Kg+/-10% but they did not give any documentary evidence of the same viz. copy of shipping bill or any export documents. However, Committee was convinced with the explanation given by the representative but for want of documentary evidence showing the exact weight of helmet, norms could not be finalized. In view of this Committee advised the representative to submit the copy of shipping bill pertaining to the advance authorization to enable the Committee to finalize norms in this case. Therefore, case stands deferred for re-listing on 02.12.2010.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that without drawing, design, sample, CAD, CAM, Lay marker etc of the end product NC is unable to ascertain the exact description of various end product mentioned therein. In normal parlance school bag could be a hand bag or shoulder bag, neck bag etc. Similarly, shopping bags could be a hand bag or shoulder bag, neck bag etc. Further, normally the material of bag is cotton or polyester or blend of the two. In view of the above position, NC is unable to clarify this case, hence decide to refer back the case to PC-IV (B) Section for their necessary action.
