At the outset the Minutes of NC Meeting No. 21/AM11 held on 19.08.2010 and Meeting No. 22/AM11 held on 26.08.2010 were ratified. The Agenda for individual cases for Meeting No. 23/AM11 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided to link with earlier case file of the firm wherein similar adhoc norms have been fixed and defer the case for re-listing on 14.10.2009.

Ltd., Mumbai NC No.23/AM11 F.No.01/85/50/440/AM07/DES-VI Dated 02.09.2010 Re-fixation of input output norms in respect of Advance Authorization No.0310412640 dated 19.12.2006. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case has already been cleared by NC with 1% wastage on item of import. Now, firm have informed that due to physical limitation of wood & hindrances with regard to cutting & shaping of wood, some of the sizes were not exported, hence, they have requested to delete the individual Qty., value & modify the same to ‘ Assorted sizes’. In view of this Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to delete the individual Qty., size from the earlier minutes and to modify the same to ‘Assorted sizes’.
The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

M/s Fashion Accessories, Gurgaon NC No.23/AM11 F.No.01/84/50/67/AM10/DES-V Dated 02.09.2010 Amendment in export product against Advance Authorization No.0510245786 dated 14.07.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case has already been approved by NC and now firm have requested for amendment in the export item. The Committee observed that firm have neither submitted measurment, CAD, CAM, calculation sheet nor any justification for asking the Qty. of inputs for the same. Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case as per written comments received from DC (MSME) conveyed vide their U.O No. 37(5)/27/2010-11/Hosiery dated 09.09.2010 as detailed below:- The GSM should match in both import & export. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that information/reply called for by DC (MSME) from applicant firm is still awaited. It was therefore decided to defer the case for re-listing on 14.10.2009.

Ltd., New Delhi NC No.23/AM11 F.No.01/84/162/217/AM11/DES-V Dated 02.09.2010 Re-fixation of input output norms in respect of Advance Authorization No.0510265065 dated 31.05.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that sketch submitted by the applicant firm does not match with the style no. mentioned on the export item. Further, from the sketch it is not clear that which sort of fabric is used for which export item. They have also not given calculation sheet, measurement and justification for asking higher quantitative requirement of inputs in this case. In view of this Committee was constrained to reject the case.
RLA may take suitable consequential action accordingly.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to rectify the adhoc norms in this case on repeat basis as detailed below: -

Reference from PC-IV(B) in respect of M/s Munib Overseas Corp. Kanpur NC No.23/AM11 F.No.01/84/162/196/AM11/DES-V Dated 02.09.2010 Clarification as to whether the export product’ cotton check sheet. Cotton check pad, cotton traveling boot, cotton winter rug and cotton leg protector are covered under DEPB rate schedule at S.No. 72 and articles made of supreme halter made of polypropylene are covered under DEPB rate schedule at S.No. 13 and P.P tapes with U.V stabilization 2% by weight plain/fabricated (a) P/P poly pad (b) poly traveling boot is covered under DEPB entry S.No. 40 of export product group ‘plastics’. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that relevant details/data case-wise alongwith complete justification were not available to take a view in the matter. In view of this Committee decided to call the applicant firm for personal hearing before NC meeting to be held on 28.10.2010 alongwith complete data pertaining to each DEPB entry pertaining to this case with sample and technical person to explain the case. This may be informed to DEPB Committee also. The case stands deferred for re-listing on 28.10.2010.
