The Meeting No. 26/AM-11 for the licensing year 2010-11 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 23.09.2010 in Room No.213 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC Meeting No. 23/AM11 held on 02.09.2010, Meeting No.24/AM11 held on 09.09.2010 and Meeting No. 25/AM11 held on 16.09.2010 were ratified. The Agenda for individual cases for Meeting No. 26/AM11 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was cleared by NC earlier but in respect of norms for Flacavon, the Qty. was inadvertently mentioned as 400 grms

M/s Richa & Co. New Delhi NC No.26/AM11 F.No.01/84/50/594/AM06/DES-V Dated 23.09.2010 Ratification of input output norms in respect of Advance Authorization No.0510167551 dated 28.09.2005. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that case is under examination of DC (MSME). It was decided to defer the case for re-listing on 21.10.2010.

Case No.261

M/s Ganga Acrowools Ltd., Ludhiana NC No.26/AM11 F.No.01/84/50/11/AM11/DES-V Dated 23.09.2010 Re-fixation of input output norms in respect of Advance Authorization No.3010065189 dated 01.02.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was cleared by NC in its meeting held on 13.05.2010 but item of import at S.No. 3 was disallowed. It was observed that in the import item at S.No. 3 firm have asked multiple of items viz., Chem:retarder/lev.agt, softner (hydr/cationic/bulky/silicon) non-ionic (washing agt), acetic acid antistatic agt softener flake, which is not specific. Further, firm have referred four similar advance authorizations, which have been regularized, Committee felt that regularization done in past has no bearing in this case. It was decided to call the applicant firm for personal hearing before NC in its meeting to be held on 21.10.2010 alongwith relevant details & justification. It was therefore decided to

M/s A.S.Marimuthu, Tamilnadu NC No.26/AM11 F.No.01/84/50/268/AM09/DES-V Dated 23.09.2010 Re-fixation of input output norms in respect of Advance

PRO version Authorization No.3510024493 dated 25.08.2008. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that NC had decided this case earlier as per request made by the applicant firm whereas in this case Qty. for dyes & chemicals was already exceeding the stipulated limit i.e 14%. Hence, Committee decided that no revision is possible at this stage.

                       Firm may be informed accordingly.

Case No.264

Reference from PC-IV (B) in respect of M/s Abhishek Industries Ltd., Ludhiana NC No.26/AM11 F.No.01/84/162/148/AM11/DES-V Dated 23.09.2010 Clarification for export product G/Bleadhing/Dyed/Made- ups/AO/W yarn under DEPBS.No.46A. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. Sanjay Mahlhotra, Sh. Kriti Vig and Sh. S.K.Sandhu, authorized representatives of the firm who appeared for personal hearing. Samples and relevant details were shown and explained. The Committee felt that R.A, Ludhiana have informed that search from Internet indicates that Bamboo Fibre is Green Natural Fibre but copy of the relevant print out has not been supplied. In view of this Committee decided to call for a copy of the same from R.A. It was therefore decided to defer the case for re-listing on 21.10.2010.

Case No.265

M/s Universal Weavers Pvt. Ltd., Palwal NC No.26/AM11 F.No.01/84/50/223//AM07/DES-V Dated 23.09.2010 Ratification of input output norms in respect of Advance Authorization No.0510188196 dated 03.08.2006. Decision: The Committee considered the case as per agenda alongwith other relevant papers and perused the detailed reply given by R.A in this case. It was observed that exports have been completed in this case, but adhoc norms have not been fixed because firm had requested for addition in the export item in past in this case. The
