Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case has already been approved by NC it is meeting held on 15.04.2010 by allowing 1% wastage. But now firm have sought addition of two more export item (i) Polyester braided tapes and (II) Polyester sinew against the advance authorization is question. The Committee felt that firm have neither given any justification for seeking items and their quantitative requirement of respective input nor size-wise specification of each item alongwith measurement, calculation sheet etc. In absence of which it is not possible to consider the request of the applicant firm, hence decided to reject the case. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that comments called for from Import Policy Division are still awaited. It was decided to defer the case for re-listing on 06.01.2011.

Therefore, Committee after deliberations in consultation with representative of technical authorities present in the meeting decided to rectify the Qty. allowed for Polyester staple fibre – 630000 Kgs (with 5% wastage) instead of 598500 Kgs. The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

M/s VSSM Varso Belts Pvt. Ltd., Tamilnadu NC No.39/AM11 F.No.01/84/50/168/AM11/DES-V Dated 23.12.2010 Authorization No.0410117219 dated 15.09.2010. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was rejected by NC due to the fact that firm did not reply to DGFT letter dated 28.10.2010. Now, also firm have not submitted their reply thereon. Further, it was also observed that earlier similar product of the firm was cleared by NC in its meeting held on 17.09.2009 and in the instant case NC has rejected on 11.11.2010, which is more than one year from 17.09.2009 (from last decision). In view of this Committee felt that the contention of firm that it is a repeat case (which is valid for only one year) and applicant’s contention that the question of submission of details does not arise is not correct. In view of this Committee decided to maintain status quo in this case.
Firm may be informed accordingly.

Decision: The Committee considered the case as per agenda and heared Sh. Shiv Nath Saini, an authorized representative of firm, who appeared for personal hearing before NC. He explained the case and stated that since firm have not confirmed order from the buyer; it is not possible to give the net weight Qty. to be accounted for in advance of export. In view of this Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case as on repeat basis detailed below: - (a) The items of import at S.No. 1 and 3 i.e 100% Polyester filament yarn and Polypropylene yarn respectively may be allowed with 5% wastage; (a) The item of import at S.Nos. 2 i.e Rubber thread may be allowed with ½% wastage and (b) The item of import at S.Nos. 4 i.e Spandex/Lycra may be allowed with 1% wastage.
The Regional Authority shall be advised to take necessary action subject to compliance of other usual conditions.
