The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting observed that since the export item is made out of multiple panels, which leads to lower wastage, the quantitative requirement of import item @ 1.85 Sq mtrs./Pc is adequate in this case. In view of this Committee decided to ratify the advance authorization issued n this case as detailed below: - Export item Export Qty. The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting felt that taking into consideration the volatile content of Silbond, 2% wastage is adequate in this case. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was cleared by NC in its meeting held on 28.11.2007. Since, export product was in assorted sizes & shapes, NC had imposed the condition that 3177 Kgs of silicone polymer should be accounted for in the export product in this case with total export Qty. 24700 (in Pairs). But, firm have exported total 22608 Pairs of assorted products instead of 24700 Pairs, which resulted in excess import of 289 Kgs in this case. In view of this Committee felt that number of Pairs of export product in this case has not much relevance on accountability angle. Hence, Committee decided that EO should be calculated on 22608 Pairs of exported item instead of 24700 Pairs without accounting the Qty. of Silicone to be accounted for against the advance authorization in question. Accordingly, applicant firm have to account for 3177 Kgs of Silicone polymer in the export product. R.A may review this case accordingly and issue EODC.

The Committee therefore decided to rectify the export Qty. accordingly i.e export Qty. may be amended to read as 84024 Pcs instead of 66000 Pcs against the advance authorization in question. R.A may regularize the case accordingly. The RLA shall be advised to take necessary action subject to compliance of other usual conditions.

Case No. 645

M/s Kitex Garments Ltd., Kochi NC44/10 dt. 28.01.2010 F.NO.1/84/50/222/AM09 -DES-V Re-fixation of input output norms against advance authorization No. 1010030279 dated 21.07.2008. Decision: The Committee considered the case as per agenda and observed that this case was cleared by NC in its meeting held on 25.09.2008. But, firm have requested for enhancement in the Qty. of inputs on repeat basis. The Committee after deliberation observed that the Policy Circular No. 34/(RE-07)/2004-2009 dated 24th March, 2008 came into existence on 24th March, 2008 and the norms sought on repeat basis for Style No. 662240 against AA under reference was of 2007. Hence, the ground for seeking quantitative norms on repeat basis in this case is not applicable. Therefore Committee decided to reject the request of the firm.
