Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the case is under examination of DC (MSME), who have asked for some information/details vide their letter dated 21.02.2011. It was therefore decided to await the same and defer the case for re-listing on 17.03.2011.

M/s Eco Wood Ldt., Kerala NC No.48/AM11 F.No.01/84/50/214/AM10/DES-V Dated 24.02.2011 Authorization No.1010036579 dated 30.12.2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case was allowed by NC in its meeting held on 07.01.2010 by allowing 3% wastage with condition that the weight of Plastisole should match in the export and import item. Now, firm informed that their import & export item do not contain Plastisole, hence, the said condition does not apply in this case. Therefore, Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to rectify the earlier decision by deleting the condition that the weight of Plastisole should match in the export and import item. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

Reference received from PC-IV (B) in respect of M/s Munib Overseas Corporation, Kanpur NC No.48/AM11 F.No.01/84/162/196/AM11/DES-V Dated 24.02.2011 Clarification as to whether the export product’ cotton check sheet. Cotton check pad, cotton traveling boot, cotton winter rug and cotton leg protector are covered under DEPB rate schedule at S.No. 72 and articles made of supreme halter made of polypropylene are covered under DEPB rate schedule at S.No. 13 and P.P tapes with U.V stabilization 2% by weight plain/fabricated (a) P/P poly pad (b) poly traveling boot is covered under DEPB entry S.No. 40 of export product group ‘plastics’. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that from the documents and material available in the file whether the export items in question are covered under particular DEPB entry at particular S.No. in terms of respective description mentioned in the relevant DEPB entry, Committee could not able to finalize for want of to the point of justification with respect of their each item in question. In this circumstance, applicant firm may give reasons/rationale/complete justification with regard to each of their item in question as to why their product should be covered under respective DEPB entry S.No. It was also felt that if applicant feel that they can explain it in personal hearing before Committee only, they may attend personal hearing in its meeting to be held on 07.04.2011 with confirmation in writing. Accordingly, Committee decided to defer the case for re-listing on 07.04.2011 under intimation to DEPB Committee also.
