Case No.:12/19/85­ALC3/2009

M/S. ORGANIC INDIA PVT.LTD. M.No. 27/10 DT. 05.11.2009 Status: Deferred   HQ File :01/85/050/00099/AM10/ RLA File :06/24/040/00014/AM10/ Lic.No/Date:0610015955 23.07.2009 The case was considered by the committee as per agenda. The representatives of applicant Firm, who were present in the meeting, explained the case.  They stated that blending of the export product is determined by the specifications of the buyer.  Further, there is no published  papers on the product from AYUSH.  After hearing the representatives of applicant Firm, Committee decided to call for the following information:­ 1. List of Extracts used for each  of the export products separately. 2. Qty. of individual inputs used for making the export products.   To be re­listed on 17.12.2009.

2 551 M/S. MSPL LTD., KARNATAKA Status: Deferred   HQ File :01/85/162/300/AM09 Fixation of wastage norms of  Mining, Handling, Processing against export of Iron Ore.     The case was considered by the committee as per agenda.  The representative of the applicant Firm was present in the meeting.    He stated that the unit is an EOU unit and no imports are made for export of Iron Ore.  Application has been submitted for fixing waste norms for Iron Ore, as the EOU Unit has, of late, started DTA Sale also. The Board of Approval has remitted the case to Norms Committee of DGFT for fixation of wastage. Committee  after  hearing  the  representative  of  applicant  Firm  felt  that  there  would  be  minor  loss  in  the  processes  involved  for  handling, processing  and transportation etc of Iron ore.  Committee therefore requested the applicant firm to furnish certified data regarding loss in mining, processing and transportation of Iron Ore separately.   Committee also observed that since  no import is  involved, there will not be input output norm in this case. Normally, Norms Committee fixes input output norms.  Therefore it was decided that case may be submitted to DG on file through Policy Division dealing with EOUs whether NC is empowered to fix process wastage, as in this case where there is no input imported/procured.   To be re­listed on 17.12.2009.         3 552
