PRO version Decision: The Committee considered the case as per agenda and observed that this case has already been cleared by NC in its meeting held on 23.02.2006. But, inadvertently the export item has been mentioned as “Girls Shirt made of 97% cotton 3% spandex denim fabric, GSM-270+/-10%” instead of “Girls Skirt made of 97% cotton 3% spandex denim fabric, GSM-270+/-10%”. In view of this Committee in consultation with the representatives of technical authorities present in the meeting decided to allow the description of export product of corrected as ‘Girls Skirt’ against the subject A/A in question.

Case No.218

M/s. Shahi Exports Pvt. Ltd. F.No. 01/84/50/412/AM-04/DES-V Re-fixation of input output norms against Advance Authorization No. 0510102826 dated 19.09.2003 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and observed that this case has already been cleared by NC in its meeting held on 16.02.2006 by imposing certain Style No. But, the firm have mentioned that they have already made export shipments under the A/A in question during 2003 whereas the ALC decided this on 16.02.2006 and as such in the export documents they could not endorse the Style No. In view of this Committee in consultation with the representatives of technical authorities present in the meeting decided that in this case the condition of Style No. may be monitored only in respect of exports made after the communication of ALC decision. Prior to ALC decision, the condition of Style No. may be waived.

Decision: The Committee considered the case as per agenda alongwith relevant papers and observed that the earlier decision of NC was as per recommendations of DC (MSME), which was based on drawing, design etc submitted by the firm. Decision: The Committee considered the case as per agenda alongwith relevant papers and observed that comments called for from Department of Revenue are awaited. It was therefore decided remind them and transfer the case file to JDG(TM) for necessary action.

Ltd., Ludhiana NC16/09 dt. 17.07.2008 F.NO.1/84/162/204/AM09 -DES-V Ratification of input output norms against Advance Authorization No.3010056948 dt. 01.07.2008 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and decided that a team comprising officers of DGFT, DIPP, DC (MSME) and R.O of TC, Noida will visit the units of the applicant firm for study the manufacturing process and submit its report to Committee for taking final view in this case. Hence, case stands deferred for re-listing on 07.08.2008.

M/s Knit foulds Pvt. Ltd. NC16/09 dt. 17.07.2008 F.NO.1/84/50/398/AM08 -DES-V Ratification of input output norms against Advance Authorization No.3100054508 dt. 02.01.2008. Decision: The Committee considered the case as per agenda alongwith relevant papers and observed that in this case export product is non-woven textile fabric, which is not being covered under SION, H-30. Further, firm was asked to furnish the detailed manufacturing process alongwith the proof of machinery involvement in Non-woven process, which are still awaited from them. It was therefore decided to advise R.A to stop show cause action in this case till final decision of NC is communicated to them. Firm may be advised to furnish the information/documents asked for in this case urgently and defer the case for re-listing on 28.08.2008.
