The Meeting No. 03/AM-09 for the licensing year 2008-09 to consider the cases under Duty Exemption Schemes (Chapter-4) of Foreign Trade Policy 2004-09 pertaining to Textiles and Leather was held on 17.04.2008 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. The Committee observed that the computation done by R.A is correct and acceptable. Hence, it was decided that the details of each case submitted by R.A may be sent to Grievance Committee as desired by them.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case is under examination of DC (MSME) and comments are still awaited from them. It was therefore decided to defer the case for re-listing on 15.05.2008.

Case No.24 M/s Orient Fashion Exports (India) Pvt. Ltd. F.No. 01/84/162/589/AM08/DES-V Fixation of input output norms against Advance Authorization No.0510205778 dt. 04.07.2007. this case is under examination of DC (MSME) and comments are still awaited from them. It was therefore decided to defer the case for re-listing on 15.05.2008.

Case No.26 M/s Model Exims F.No. 01/84/162/715/AM07/DES-V Fixation of norms/modification of SION in respect of leather goods and other suggestions regarding the Policy decision. procedure viz. furnishing of relevant industry data, dully filled up/authenticated in the prescribed Aayat Niryat Form for modification of SION and for allowing fuel, duty free import of fuel for generating power, has not been followed by the Council. In view of this Committee decided to advise CLE for strict compliance of the same to process the case further. The case may be re-opened on receipt of the above details.

Case No.27 M/s J.B Exports F.No. 01/84/50/737/AM08/DES-V Fixation of input output norms against Advance Authorization No.5210018934 dt. 16.02.2006. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh.Mahendra Sancheti, Director and Sh. Lambi, a technical person of the firm, who appeared for personal hearing in this case. He explained the case alongwith Sample. The Committee, after detailed deliberations in consultation with representatives of technical authorities present in the meeting felt that in order to compute the actual requirement of inputs alongwith wastage involved therein, a spot study is needed. In view of this Committee decided that a team of officers from DGFT, DC (MSME), R.O., T.C. Noida and DIPP shall visit the unit of the firm to study the manufacturing process involved in this case to assess the % of wastage. The case will be re-opened on submission of the report of the above team.

Case No.30 Recd. from PC-I Section, DGFT, New Delhi. F.No. 01/94/180/945/AM08/PC-I Regarding issue of Scrip under the Target Plus Scheme by Jt.DGFT, Mumbai – reference received from Commissioner of Customs, Kandla. Decision: The Committee considered the case as per agenda alongwith relevant papers received from PC-I Section. The Committee heard Sh. Jatin. P, an authorized representative of M/s Anunay Fab. The Committee considered the case as per agenda alongwith relevant papers and observed that ALC in its meeting held on 27.03.2003 had allowed the import item fusible interlining of relevant thickness – 11687 Sq mtrs. instead of 14500 Sq mtrs. against the export of 51000 pairs of Gents/Ladies Leather Shoes/Boot. But due to decrease in the buyer’s order of export product i.e from 51000 pairs to 31994 pairs, firm proportionately imported 9393.60 Sq mtrs. instead of 14500 Sq mtrs. fusible interlining in this case. Firm have also completed E.O on 05.02.2004 against the A/L in question and thereafter, R.A had amended the quantity of fusible interlining i.e 11687 Sq mtrs instead of 14500 Sq mtrs. against the A/L in question. In view of this, Committee after detailed deliberations in consultation with the representatives of technical authorities present in the meeting decided to advise R.A to redeem the A/L on pro-rata basis as per actual export-import made in this case.
