The Meeting No. 45/AM-09 for the licensing year 2008-09 to consider the cases under Duty Exemption Schemes (Chapter-4) held on 05.02.2009 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. Thereafter, Agenda for individual cases for Meeting No. 45/AM09 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Decision: The Committee considered the case as per agenda and observed that advance authorization is to be issued under Duty Exemption Scheme in which imported inputs are used in the export item. The Committee observed that in case of export item No. 1, input is actually being exported without any physical change in the import item. Moreover, the process involved in this case is merely re-packing, which is a minuscule process. In view of this Committee decided to disallow the item of import No. 1 against export item No. 1. Ltd., Kolkata F.No. 01/84/50/11/AM-07/DES-V Ratification of input output norms against Advance Authorization No. 0210088389 dated 18.04.2006 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard Sh. T.D.Prasad, Director in the firm, who appeared for personal hearing alongwith two authorized representatives. They explained the case alongwith drawing, CAD and sample pertaining to this case. The Committee after detailed

PRO version deliberations in consultation with representatives of technical authorities present in the meeting felt that as regards import item No. 3 i.e Knitted Kevlar Cuff, the earlier allowed Qty. @ 0.17 mtr./pair was computed assuming that the same was used in a single layer (not in double layer), whereas in the sample given, the Cuffing is of double layer. In view of this Committee decided that the earlier Qty. for import item No. 1 i.e Knitted Kevlar fabric may be enhanced from 0.23 Sq mtrs/pair to 0.34 Sq mtrs./pair and similarly for import item No. 3 i.e Knitted Kevlar Cuff, the earlier Qty. may also be enhanced from 0.17 mtr./pair to o.40 mtr/pair in this case.

Ltd., Gurgaon F.No. 01/84/162/583/AM-09/DES-V Fixation of input output norms under Annual Advance Authorization No. 0510195470 dated 01.12.2006, 0510222193 dated 16.06.2008, 0510230380 dated 05.11.2008, 0510221277 dated 30.05.2008 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and handed over the relevant details available in the case file to DC (MSME) for their examination and comments.

It was observed that Export Obligation was completed prior to the communication of the ALC decision by allowing the item of import as applied for in this case. The Committee after detailed deliberations in consultation with
