The Meeting No. 18/AM-09 for the licensing year 2008-09 to consider the cases under Duty Exemption Schemes (Chapter-4) of 31.07.2008 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC Meeting Nos. 13/AMO9 dated 26.06.2008, 14/AMO9 dated 03.07.2008, 15/AMO9 dated 10.07.2008, 16/AMO9 dated 17.07.2008 were ratified. The Agenda for individual cases for Meeting No. 18/AM09 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Therefore, Committee was constrained to reject the request of firm.

Decision: The Committee considered the case as per agenda and observed that this case has already been cleared by ALC in its meeting held on 22.11.2007 by imposing certain Style No. But, the firm have mentioned that they have already made export shipments under the A/A in question during 2003 whereas the ALC decided this on 22.11.2007 and as such in the export documents they could not endorse the Style No. In view of this Committee in consultation with the representatives of technical authorities present in the meeting decided that in this case the condition of Style No. may be monitored only in respect of exports made after the communication of ALC decision. Prior to ALC decision, the condition of Style No. may not be insisted upon. In future, applicant firm have to invariably mention specific style no. of their export product

Decision: The Committee considered the case as per agenda alongwith other relevant papers and heard S/Sh. Kiran Mehta and Virendra Sahu, authorized representatives of the firm, who appeared for personal hearing in this case. They submitted CAD/CAM, Laymarker & export documents alongwith sample and explained the case. The Committee in consultation with the representatives of the technical authorities present in the meeting analyzed the case and decided that total 25% wastage is adequate in this case. Hence, it was decided to allow 25% wastage on item of import, but on no repeat basis.

The Committee after deliberations in consultation with the representatives of technical authorities present in the meeting felt that there is no justification for enhancement of the Qty. of inputs, as such the Qty. allowed by NC is adequate.
