The Meeting No. 28/AM-08 for the licensing year 2007-08 to consider the cases under Duty Exemption Schemes (Chapter-4) of Foreign Trade Policy 2004-09 pertaining to Textiles and Leather was held on 18.10.2007 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset, the Minutes of NC Meeting No.26/AM08 held on 04.10.2007 and 27/AM08 held on 11.10.2007 were ratified by the Committee. Thereafter The Agenda for individual cases for Meeting No. 28/AM08 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

No.07/24/40/116/AM08. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that as per documents/details submitted by the firm, the total export order for Men’s Pants is 4280 Pcs, whereas applicant, in the application have mentioned 6799 Pcs against the export Qty. for the same. Similarly, as per details given in Order, total export Qty. for Men’s Jackets is 1200 Pcs, whereas applicant, in the application have motioned 1260 Pcs against the export Qty. for the same. Moreover, the requirement of import item against export product-wise has not been given. In view of this it appears that export order submitted by the firm does not relate to this case. Hence, Committee decided to reject the case.

No.32/24/40/030/AM08. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that drawing of export product submitted by the firm does not indicate the requirement of import items export product-wise. In other words, it is not clear that which import items are required for which export products out of 3 export products. Accordingly, Committee was not in a position to compute the requirement of 6 import items export product-wise and in the absence of above details decided to reject the case.

It was observed that earlier NC had decided this case on the basis of recommendations of DC (SSI) allowing import items from S.No 1 to 4 as firm had not submitted the details of remaining import items. Now, DC (MSME) have sent their recommendations based on the details submitted by the firm in respect of all import items. Accordingly, Committee decided to ratify the advance authorization issued in this case on the basis of recommendations of DC (MSME) as detailed below: -
