The Meeting No. 18/AM-08 for the licensing year 2007-08 to consider the cases under Duty Exemption Schemes (Chapter-4) of Foreign Trade Policy 2004-09 pertaining to Textiles and Leather was held on 09.08.2007 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC Meeting No. 17/AM08 held on 02.08.2007 were ratified by the Committee. Thereafter the Agenda for individual cases for Meeting No. 18/AM08 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Accordingly the application has been sent to T.As on 02.08.2007 and presently under examination of DC (MSME)/TC, Mumbai. In view of the above, decided await comments from them and defer the case for re-listing on 06.09.2007.

Committee, in consultation with technical authority decided to ratify the Advance Authorisation issued in this case, taking a cue from relevant SIONs for Pants & Shirts, by allowing the export item @ 4.60 Sq mtrs./Pc.

The RLA shall be advised to take necessary action subject to compliance of other usual conditions.

The items of import at S. No. 3 and 4 may be allowed on net to net basis with accountability clause.

Ref. Chelsea Mills. NC 18/08 dt. 09.08.2007. F.No. 01/84/50/281/AM-07/DES-V Amendment in Advance Licence No. 0510190845 dt. 14.09.2006. Decision: The Committee considered the case as per the agenda alongwith other relevant papers and observed that this case has already been cleared by NC in its meeting held on 14.12.2006 wherein import items viz., Rivets and Buttons were allowed in Nos. Firm, now requested that these items should be allowed in Sets in place of Nos. The Committee, in consultation with the technical authorities present in the meeting decided to allow these items in Sets instead of Nos against this Advance Licence.

Case No.376

Ref. Chelsea Mills. NC 18/08 dt. 09.08.2007. F.No. 01/84/50/521/AM-07/DES-V Amendment in Advance Licence No. 0510199914 dt. 22.02.2006. Decision: The Committee considered the case as per the agenda alongwith other relevant papers and observed that this case has already been cleared by NC in its meeting held on 24.05.2007 and TC, Mumbai vide their letter dated 10.07.2007 have sent their written comments in this case. In view of this Committee decided that written comments of TC, Mumbai may be taken on record and status quo may be maintained in this case. The Committee also felt that a D.O letter from Chairman, NC-III should be sent to DC (MSME) and TC, Mumbai inviting their attention towards such delay in sending their comments, as A/As are required to be ratified within time frame as per existing Policy.

The quality of fabric used in the export products should conform with the quality of fabric imported in terms of GSM, fibre composition and special finish (if any) imparted to the fabric. Decision: The Committee considered the case as per the agenda alongwith other relevant papers and observed that export product items does not pertain to DES-V Section. Therefore, it was decided to transfer this case to relevant Section i.e. DES-IV Section.

Decision: The Committee considered the case as per the agenda alongwith other relevant papers and observed that CLA have sought confirmation regarding Norms Committee decision as to whether in the applicant firm’s case, export product has been revised from Shirts H/S to F/S. In view of the above, it was confirmed that the above change of export product from Shirts H/S to F/S is as per Norms Committee decision. It was therefore decided to advise the Regional Authority to take necessary action accordingly subject to compliance of other usual conditions.
