Marimuthu Ltd. have requested to amend the existing stipulation of 14% restriction of FOB value of Dyes & Chemicals against their import on account of their use of specialty Chemicals. It was also observed that the request is also recommended by TEXPROCIL (The Cotton Textiles Export Promotion Council), Mumbai. The General Note for Textiles, Para No. 5, stipulates the import of Dyes & Chemicals up to the FOB value of the total export item. The Committee felt that this condition was imposed to control the excess import of Dyes & Chemicals more than that of actual requirement. However, it was observed that the units M/s Loyal Textiles, M/s JCT Ltd, M/s Arvind products Ltd. and M/s A S Marimuthu Ltd. and others are manufacturers and exporters of FR (Fire Retardant) treated Cotton fabrics/products. FR and associated Chemicals used in manufacturing of such products are very expensive and the consumption of these Chemicals is also very high as compared to normal Chemicals used for normal processed products. The products treated with such specializing Chemicals are demand specific, requiring certain specified
PRO version standards. In order to meet such quality standards/parameters, requirement of such Chemicals and other additives is quite high. The Committee also perused the recommendations of DC (MSME) conveyed vide their U.O dated 25.03.2011 and observed that as per data submitted by M/s Loyal Textiles, the CIF value of FR comes to 27.96% of FOB value, for M/s JCT Ltd., the same is 26.26% and for M/s Arvind Product Ltd., the same comes to 30.48%. Thus, taking average value of these three units, the limit comes to 28%. The Committee felt that earlier ceiling of 14% is inclusive of normal Chemicals used alongwith Dyes for processing of textile products, hence, this ceiling upto 26% is justified. The Committee also felt that in addition to the above specialty product(FR treated), there is another specialty product in demand and the same are for Water, Oil and Stain repellant textile products requiring expensive specialty Chemicals in higher quantity and for which also, the existing ceiling of 14% is required to be enhanced to 26% i.e additional 12%. Accordingly, the Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to recommend for enhancing the existing ceiling of 14% to 26% in the General Note for Textiles, Para No. 5.

It was therefore decided to amend the existing General Note for Textiles, Para No. 5 as detailed below:-
“Wherever import of dyes is permitted, the same will be restricted to 12% of FOB value within the overall CIF value of the licence. Wherever, import of dyes and chemicals has been permitted, the same will be restricted to 14% of FOB value within the overall CIF value of the licence except in respect of J.28 where the same will be restricted to 16% of FOB value within the overall CIF value of the licence. For specialty textile products like Fire Retardant textile product as well as for Water, Oil and Stain repellant textile products, the same will be restricted to 26% of FOB value within the overall CIF value of the licence. On the above lines, Committee decided that a suitable Public Notice may be issued for incorporation/amendment in the existing General Note for Textiles, Para No. 5 with the approval of DGFT.
