The Meeting No. 27/AM-08 for the licensing year 2007-08 to consider the cases under Duty Exemption Schemes (Chapter-4) of Foreign Trade Policy 2004-09 pertaining to Textiles and Leather was held on 11.10.2007 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. Allahdad Tannery NC 27/08 dt. 11.10.2007 F.No. 01/84/50/627/AM-06/DES-V Ratification of input output norms against Advance Authorisation No.0610010155 dt. 15.12.2005 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and perused written comments of CLRI, Chennai conveyed vide their letter dated 10.09.2007. Committee after detailed deliberation and in consultation with representatives of technical authorities decided to ratify the Advance Authorization issued in this case as detailed below: -
(i) 40 Kgs Sodium Sulfide/1000 Sq.ft may be allowed as against 5 Kgs; (ii) 75 Kgs of Chrome tanning agent may be allowed as against 50 Kg. (iii) Fatliqours 30 Kgs may be allowed as against 24 Kg and a new item Sulfonated fish oil meant for leather, 10 kg may be allowed. However the Syntan requirement is reduced from 54 kg to 25 kg. (iv) 10.5 Kgs fillers for leather industry may be allowed as against 3 kg as per SION at S. No. G-7. (v) Remaining items may be allowed as per SION at S. No. G-7.
The R.A shall be advised to take necessary action subject to compliance of other usual conditions in modification of decision taken earlier in meeting held on 20.7.2006.
Committee also decided to take similar action in respect of M/s.Model Tanners (India) Pvt.Ltd., Advance
Authorisation No. 0610010188 dt. 23.12.05. The RLA may take necessary action on the above lines in modification of earlier decision taken in meeting held on 16.2.2006.(F.NO.01/84/50/649/AM06/DES.V)

M/s. Floor Décor. NC 27/08 dt. 11.10.2007 F.No. 01/84(84)/50/053/AM-08/DES-V Ratification of input output norms against Advance Authorisation No.1010072072 dt.
PRO version 6.8.2007 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and observed that description of export product does not reveal that the same is definitely undergoing the process of printing. Further, description of import item also does not specify as to whether it is in roll form or in cut to size form. In view of this Committee decided to reject the case.
RLA may take suitable consequential action accordingly.

Gupta Enterprises NC 27/08 dt. 11.10.2007 F.No. 01/84/162/765/AM-08/DES-V Ratification of input output norms against Advance Authorisation No.0410090397 dt. 01.8.2007 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and observed that firm have not furnished stage-wise wastage to justify their claim for a total wastage of 20%. In view of this Committee decided to reject the case.
RLA may take suitable consequential action accordingly.

M/s. Baliga Fishnets. NC 27/08 dt. 11.10.2007 F.No. 01/84/162/764/AM-08/DES-V Ratification of input output norms against Advance Authorisation No.0710052729 dt. 06.8.2007 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and observed that Import description “Nylon Yarn 1890 Denier & below” does not specify any range and such a description of import is not permitted as it will lead to
PRO version wide variation in denierage. Similarly export description “Made up fishing Nets of Nylon 1890 Denier & below” will lead to a wide variation in denierage and can’t be permitted. Hence, it is not possible to establish nexus between import and export. In view of this Committee decided to reject the case.
RLA may take suitable consequential action accordingly.

M/s. VMT Spinning Co. Ltd., Ludhiana. NC 27/08 dt. 11.10.2007 F.No. 01/84/50/555/AM-07/DES-V Re-fixation of input output norms against Advance Authorisation No.3010051223 dt. 16.3.2007 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and perused the written comments of TC, Mumbai conveyed vide their letter No. 27/13/07/Spg./47 dated 21.05.2007. Committee after detailed deliberation and in consultation with representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case in partial modification of its earlier decision taken on 28.06.2007 as detailed below: - Export Product Export Qty. PRO version 23.4.2004 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda and observed that Qty. of input recommended by TC, Mumbai vide their letter dated 07.07.2004 is 0.57 Sq mtrs./Pc and DC (SSI) vide their U.O dated 14.07.2004 has recommended @ 0.68 sq.mtrs/Pc. and there is a variation between these two recommendations. In view of this Committee in consultation with representatives of technical authorities present in the meeting decided to ratify the Advance Authorization issued in this case by taking average of the both the recommendations given by TC, Mumbai and DC (SSI) as detailed below: - Export Product Export Qty. Import Item as applied for Qty. allowed per Pc of export product. The quality of fabric used in the export products should conform with the quality of fabric imported in terms of GSM, fibre composition and special finish (if any) imparted to the fabric. The R.A shall be advised to take necessary action subject to compliance of other usual conditions. They have to find out the Style No. in respect of export product mentioned above from firm and check/monitor the same by imposing Style No. on export side.

Decision: The Committee considered the case as per agenda and perused the report submitted by the team of officers consisting of officers from R.O, TC, Noida, DC (MSME) and DGFT after conducting an inspection of M/s Prakash Woollen Industries, Panipat alongwith the unit of M/s Faze Three Ltd, Panipat. Against the subject A/A, firm imported the finished Polyester blankets duly hemmed from China and after unpacking the same individual blanket was embossed with Client’s logo with the help of high temperature heat press Machine i.e. Heat Press Embossing Machine. Thereafter, the blankets were repacked in bales of 30 Pcs each and exported out of Country. Committee felt that only embossing work is being done which is a minor and miniscule process not covered under the provision of Para 4.7 of Handbook of Procedures. In view of this Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to reject this case

Case No.2 M/s. Faze Three Ltd. NC 27/08 dt. 11.10.2007 F.No. 01/84/50/23/AM-07/DES-V Ratification of input output norms against Advance Authorization No. (i) 0310372017 dt. 17.03.2006, (ii) 0310373227 dt. 24.03.2006, (iii) 0310376683 dt. 20.04.2006, (IV) 0310425137 dt. 30.03.2007 and (v) 0310370594 dt. 09.03.2006 Decision: The Committee considered the case as per agenda and perused the report submitted by the team of officers consisting of officers from R.O, TC, Noida, DC (MSME) and DGFT after conducting an inspection of M/s Prakash Woollen Industries, Panipat alongwith the unit of M/s Faze Three Ltd, Panipat. Against A/A No.
PRO version 0310372017 dt. 17.03.2006, the unit has completed the manufacturing of Nylon rugs and the exports under other A/A mentioned above of the firm have been done from the firm’s units located at Dapada and they have completed the E.O against this A/A. As regards other A/As, the raw material is being processed for manufacture of export product at firm’s unit situated in the Union Territory of Dadar and Nagar Haveli as such Panipat unit of the firm is not in a position to give the details. Therefore, team of officers advised to submit the following documents/information: - (a) Copies of Bills of Entry regarding imports made against the Advance Authorization No. 0310372017 dt. 17.03.2006; (b) Photo copies of shipping bills; (c) Manufacturing process and flow chart alongwith stage-wise wastage; (d) Copy of foreign buyers order; (e) Net content of Nylon Yarn in export product.
The above details have not been submitted by firm so far.
In view of this Committee after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to reject all the above cases of the firm. .
RLA may take suitable consequential action accordingly.
