Minutes of the Meeting NC-V held on 08.05.2008
The Meeting No. 06/AM-09 for the licensing year 2008-09 to consider the cases under Duty Exemption Schemes (Chapter-4) of Foreign Trade Policy 2004-09 pertaining to Textiles and Leather was held on 08.05.2008 in Room No.4 of DGFT under the Chairmanship of Shri A.K.Singh, Jt. At the outset the Minutes of NC Meeting 03/AMO9 held on 17.04.2008 were ratified. The Agenda for individual cases for Meeting No. 06/AM09 was taken up for discussion and the decision taken in respect of each case is enumerated below: -

Decision: The Committee considered the case as per agenda and in consultation with the representatives of technical authority present in the meeting decided to ratify the Advance authorization issued in this case on the basis of report furnished by the team of officers, who had visited the units of the firm in partial modification of its earlier decision as under: -
(a)The item of import at S.No.1 may be allowed @ 1.13 Kgs./Kg on Solid Content basis and its description may be amended to read as “ Latex Compound (SBR and Natural Rubber Base) Average Solids 60 – 70%. (b) The item of import at S.No.2 i.e Woven Backing Fabric may be allowed @ 1.13 Sq. Mtrs./Per Sq. Mtrs of export product. Case No.75 M/s. Zazman Exports, Kanpur. F.No. 01/83/50/157/AM-04/DES-V Re-fixation of input output norms against Advance Licence Nos.0610005573 dated 12.6.2003; 0610005572 dated 12.6.2003 and 0610005571 dated 12.6.2003. Decision: The Committee considered the case as per agenda alongwith other relevant papers and heared Major J.S.Sodhi, an authorized representative of the firm, who appeared for personal hearing in this case. He explained the case stating that the inputs asked for against the A/L Nos. in question are actually covered under SION, G-14. However, ALC in earlier decision had allowed the inputs against these A/L Nos. as per SION, G-13. The Committee felt that there was an error in previous decision of ALC in these three cases (1. Advance Licence No .0610005573 dated 12.6.2003 2. 0610005572 dated 12.6.2003 and 3. 0610005571 dated 12.6.2003). In view of the above, Committee after deliberations in consultation with representatives of technical authorities present in the meeting decided to allow all the inputs as per SION, G-14 against the A/L Nos. 1. Advance Licence No .0610005573 dated 12.6.2003 2. 0610005572 dated 12.6.2003 and 3. 0610005571 dated 12.6.2003.
The R.A. shall be advised to take necessary action subject to compliance of other usual conditions. A compliance report on these cases may be sent to DGFT, HQs, New Delhi.
Case No.76 M/s. Youngman Woollens Mills Pvt. Ltd., Ludhiana. NC 06/08 dt. 08.05.2008 F.No. 01/84/162/369/AM07/DES-V Redemption against of Advance Licence No.3010030502 dt.23.12.2003. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that

Case No.77 M/s. SRF Ltd., Tamil Nadu. F.No. 01/84/50/1386/AM-08/DES-V Ratification of input output norms against Advance Authorisation No.0410091662 dated 22.10.2007 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the reply/information called for from firm is still awaited. It was therefore decided to await the same and defer the case for re-listing on 05.06.2008.
Case No.78 M/s. Kabadi Shankarsa and sons, Bangalore F.No. 01/84/162/673/AM-06/DES-V Ratification of input output norms against Advance Authorisation No.0710041461 dated 17.11.2005 – under Para 4.7 of HBP (Vol.I) 2004-2009. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that this case has already been decided by NC in its meeting held on 25.10.2007 as per written comments of DC (MSME), which was based on CAD, Design, Style etc, submitted by the firm. The Committee did not find any scope to review the Qty. of inputs allowed in this case. Hence, decided to maintain status quo. Thus, request of the firm cannot be acceded to, hence rejected.
RLA may take suitable consequential action accordingly. They may also be advised to furnish compliance
report whether style No. imposed on the export side in earlier decision of NC has been complied.
Case No.79 M/s. Baliga Fishnets
PRO version F.No. 01/84/162/764/AM-08/DES-V Regarding amendment in SION, H-158. Decision: The Committee considered the case as per agenda and observed that the reply called for from EPC is still awaited. In view of this Committee decided to await the same and defer the case for re-listing on 19.06.2008.
Outside agenda
As per approval of the NC, the team comprising officers of DGFT, DIPP, DC (MSME), R.O of TC, Noida and Deptt. of Revenue conducted visit of the factory of M/s Aditya Birla Nuvo Ltd., Kolkata on 11.04.2008 and submitted its report to Norms Committee. The Committee perused the report and decided to take on record the same.
